Speaker of Parliament punishes CCC legislators for snubbing Mnangagwa

Speaker of Parliament Jacob Mudenda has ordered the forfeiture of travelling and hotel allowances for opposition Citizens Coalition for Change (CCC) legislators who humiliated President Emmerson Mnangagwa on Tuesday by boycotting his State of the Nation address at the opening of the 10th Parliament in Mount Hampden.

CCC MPs failed to attend the first session of the Parliament as a protest against Mnangagwa whom they accuse of being illegitimate and a product of a disputed 2023 harmonised general elections.

Against this background, Mudenda ordered the Clerk of Parliament to make sure that the legislators will not be given fuel coupons and will pay for their hotel bills.

“It is therefore clear that there have been some violations of those Standing Orders. Members of the CCC have come to Harare after Parliament was summoned by His Excellency, the President and have stayed in hotels and have been given and facilitated their travel to Harare,” Mudenda said.

“Therefore, there have been violations of these Standing Orders and in terms of powers invested in me as Speaker, I instruct the Clerk of Parliament to ensure that CCC members will not receive their coupons to go back home.

“Secondly, their stay in hotels at the taxpayers’ generosity and commitment will be deducted from their salaries. I further request the Leader of Government Business to look into the Political Parties Finance Act to find out whether further sanctions cannot be applied.”

The August 23 and 24 elections were marred by numerous irregularities including voter suppression. Ballot papers were delivered late in most urban areas where the opposition is deemed to have the most support.

Regional and international observers noted that the elections fell short of the requirements of the Constitution of Zimbabwe.

Mnangagwa, however, emerged as winner with 52,6% against CCC leader Nelson Chamisa’s 44%.

The opposition is calling for a fresh election supervised by the Southern African Development Community (SADC).

Writing on his X handle on Tuesday Chamisa said dialogue is needed to resolve the current political crisis.

“Flawed elections and disputed national processes produce flawed outcomes and disputed leaders! To resolve all this, there must be a political settlement to return Zimbabwe to majority rule.

“The struggle for real change, justice and freedom takes a new twist. Zimbabwe shall be free. The people shall govern,” he said.

The main opposition leader in Seychelles, Patrick Herminie, has been charged with witchcraft, along with seven others.

Police say the case is related to the discovery of two bodies exhumed from a cemetery on the island of Mahé.

He has denied the charges, telling local media that his prosecution is a “political show” to taint his image.

Mr Herminie plans to run in the 2025 presidential election under the banner of the United Seychelles Party (USP).

A magistrates court on Monday freed him and six of his Seychellois co-accused on bail of 30,000 Seychelles rupees ($2,100; £1,745), but ruled that a Tanzanian suspect should stay in custody until the next court appearance in November.

Mr Herminie and his co-accused face several charges, including possession of items intended for use in witchcraft, conspiracy to perform witchcraft and procuring services related to witchcraft, according to local media reports.

Prosecutors allege that the opposition leader’s name appeared in a WhatsApp message between a Seychellois national and the Tanzanian suspect, who was arrested on 21 September at the main international airport.

The Tanzanian was found with items related to witchcraft, including stones, black wooden artefacts, small bottles of brownish liquid, a collection of powders, and documents with strange language and “demonic and satanic” symbols, they said.

The documents were similar to those found in Catholic churches and other places that had been vandalised in Mahé, Seychelles’ largest island, prosecutors further alleged.

Mr Herminie, who served as the speaker of Seychelles’ parliament between 2007 and 2016, told local media that more than 40 police officers had raided his party’s offices in the capital, Victoria, on Friday.

He added that the officers searched for items related to witchcraft, including “bones, body parts, and objects associated with Christianity” but did not find any.

Mr Herminie described his arrest as “a political show” by President Wavel Ramkalawan to “eliminate those who he knows will remove him from power in the 2025 elections”, the Seychelles News Agency reported.

President Ramkalawan has not commented on the case.

Mr Herminie has said he does not believe in witchcraft.

“In Seychelles’ history, there has never been until now, a political party leader arrested for superstition and witchcraft. This is something new and it is shameful for Seychelles,” he was quoted as saying. BBC News

South African actor Sello Maake kaNcube’s marriage to businesswoman Pearl Mbewe is reportedly hanging in the balance, after his family failed to turn up for a lobola payment ceremony recently.

KaNcube, who paid part of the lobola two years ago, reportedly told Mbewe he was now ready to finish payment, hence their decision for Mbewe to leave their home and wait for her groom’s family at her home in Soweto.

However, on the set day, KaNcube’s family never came, as Mbewe’s family waited the whole day in hope.

According to Zimoja, this is due to the fact that KaNcube is now reconsidering his commitment to Mbewe.

Complicating matters is the fact that KaNcube is reportedly still living in the same household with his ex-wife, despite Mbewe’s presence. Their family home also accommodates some of his children and grandchildren.

“Sello still lives with his ex-wife, daughter, grandchildren and Pearl in the same house. It seems like he is dealing with a lot right now.

“While he loves Pearl, I think he’s struggling to balance his family and new marriage. Despite nothing going on between him and his ex-wife, their shared history might be adding to the tension,” said the source.

Since the KaNcube family’s no-show, Mbewe has refused to return to their home, as she is believed to be hurt and embarrassed by what transpired.

According to the source, some people close to the actor felt Mbewe now had too much influence in his life and encouraged him to pull out of the lobola ceremony.

“They seem to be forgetting that not only did Pearl make his brand stronger again, but she also has been making sure that he is making money.

“That woman is educated, articulate, and skilled in client communication, setting her apart from many other managers and agencies. She is the real deal,” said the source.

In an interview with News24, Mbewe refused to indulge speculation on the state of her union with KaNcube.

“People will always believe what they want. Let’s let them be! The truth will prevail,” she said.

South African actress Khanyi Mbau and raunchy dancer Zodwa Wabantu are set to square off in a high-profile celebrity boxing match at the Ridge Hotel in Mpumalanga on October 22, giving both ladies a chance to address tensions stemming from their previous love triangle with fallen ex-billionaire Mandla Mthembu.

The boxing bout was confirmed to The Sowetan by promoter, Arnold “Squire” Nododile who said he expected the fight to be the first of many such exhibitions.

Celebrity fights in South Africa have been popularised by rapper Cassper Nyovest, who has taken part in three such bouts.

“This will be the first ever female celebrity exhibition boxing match-up on the African Continent since such fights have become part and parcel of the evolution of boxing around the globe,” said Nododile who acquired a promoter’s licence with BSA three months ago.

On the same card, Mapule Ngubane from South Africa will battle Charity Mukami Mutwiri from Kenya while South African Sazisiwe Simon will go against Pamela Matunga from Zimbabwe.

Also on the bill will be Matshidiso Mokatsane from the Free State who will go against Monalisa Takane from the Eastern Cape while Asanda Simelane from North West will go head-to-head with Nomfundo Xaba from KwaZulu-Natal.

“I expect a big attendance due to the massive following they have,” Nododile said of the fight between Mbau and Zodwa.

The two ladies have a chequered history, as they are both believed to have a child by Mthembu.

In an interview on MacG’s podcast in 2020, Mbau revealed how Mthembu, who she was married to, had cheated on her with Zodwa when she was pregnant.

She said Mthembu’s relationship with Zodwa felt more genuine than the one she enjoyed with him.

“I worshiped him, I saw him as my hero he saved me, he gave me all I dreamt about, he was like a god to me. Mandla and I never had a normal conversation with each other just to say, what do you like? How are you feeling? What hurts you?

“We would always talk about fashion, cars, what’s the next location, whose party are we going next to? So, we have never actually had conversations and I realized this when I was eight months pregnant where I couldn’t run around that’s when I realized that I was in trouble.

“When I was pregnant at times I never wanted to be touched, thats the gap that Zodwa found and filled. She gave him stuff that I couldn’t give him, they had conversations that we never had, and they bonded like for real.

“For us it was always he wanted to impress me all the time but with Zodwa it was real, they sat in her garage, their love was real.

“Remember this guy is a guy from the hood who just managed to bump into millions so is still hood and I am north, I am suburban so he met someone in his world that how she won him,” she said.

Humiliation for Agriculture Minister as he loses court case to subordinate

Agriculture Minister Anxious Masuka has lost a High Court challenge against his subordinate former Grain Marketing Board (GMB) chief executive Samuel Muvuti whom he wanted to repossess his farm for the reason that it is underutilised.

Muvuti and his wife, Joylene approached the High Court seeking a review of the minister’s decision canceling their lease agreement which was issued under the land reform and resettlement programme.

They argued that Masuka’s withdrawal of their offer letter was in violation of the Administrative Justice Act s. 3(1)(a).

Their farm, Holme Head was cited as the third applicant in the application.

The farm was registered as an agricultural based business which is into commercial farming of soya beans, maize and wheat on less than 400 hectares of arable land.

Muvuti is a beneficiary of the land reform and resettlement programme.

He was offered a part of the farm in dispute following its downsizing by the minister.

The couple told High Court judge Justice Siyabona Musithu that they have been carrying out farming operations at the farm from the time it was allocated to them in 2004.

On 12 October 2020, they received a letter from the first respondent (Masuka) advising him of his intention to withdraw the offer of land.

The reason given for the withdrawal of the offer was to downsize the farm so that it conforms to maximum farm sizes.

The first applicant made representations to the minister highlighting that the whole farm did not comprise arable land.

“More than 400 ha comprised of sand and part of the farm was also characterized by mountains, hills, wetlands and seasonal streams which were also not ideal for farming.

“If the farm was to be downsized, then that would significantly reduce crop yields as well as affect viability to continue with farm operations,” the court was told.

On 11 January 2021, the minister wrote another letter to Muvuti notifying him of the cancellation of their 99 year lease agreement. The reason given for the cancellation was that the farm was being underutilised.

They were given three months’ notice to conclude farming operations. In their letter, the applicants further argued that the farm was one of the most productive farms in the Mvurwi area.

They had even partnered Agribank Mvurwi in the harvest of their wheat crop.

They had also managed to pay 90% of their Command Agriculture debt with CBZ Agro Yields in the sum of six million dollars.

For the 2020/21 summer they had put 120 hectares under commercial maize and 40 hectares under soya beans.

The applicants also submitted that they had done massive infrastructure upgrades on the farm over the years they had been in occupation.

In addition, the land under pivot irrigation had been increased from 60 to 180 hectares over time.

In his reply dated 20 April 2021, Masuka argued that their submissions did not outweigh the reason for the downsizing of the farm to ensure maximum utilization from the current 200 hectares to a potential of at least 500 hectares.

He also said there were also complaints against them by another individual who stated that when he arrived at the farm, the couple was struggling to commence land preparations. Only 28 hectares had been prepared.

There was an outstanding bill of US$2, 400.00 owed to two owners of tractors that were stationed at the farm.

The third party settled that bill on behalf of the applicants.

But the judge ruled in favour of Muvuti noting that the minister’s decision was irrational.

“The mere act of changing the reasons for terminating the lease agreement midway without adequately applying his mind to the applicants’ earlier representations in response to his first communication was grossly unreasonable.

“Instead of dealing with the applicants’ representations which he had invited them to make, the first respondent came up with another basis for terminating the lease.

“The first respondent was not only expected to act lawfully, but in a reasonable and fair manner. If the reason for terminating the lease was to allow for downsizing of the farm in order to conform to farm sizes, then the authority to do so needed to be set out.”

The judge said from a reading of the papers, it is clear that no proper verification of the extent of utilisation of the land was done prior to the decision to terminate the lease on account of underutilisation of the land.

Former G40 administrator’s US$868 000 lawsuit dismissed by High Court

Rodney Dangarembizi (circled) was once arrested after he was accused of authoring a letter that was read by former G40 member Kudzai Chipanga insulting now vice president Constantino Chiwenga a day before "Operation Restore Legacy" in November 2017

The High Court has dismissed a counter claim filed by Rodney Dangarembizi who had sued the Kaizen Family Trust for US$868 000 while the Family Trust also sued the latter for US$432 000.

Dangarembizi was once arrested after he was accused of authoring a letter that was read by former G40 member Kudzai Chipanga insulting now vice president Constantino Chiwenga a day before “Operation Restore Legacy.”

High Court judge Justice Sylvia Chirau Mugomba dismissed the case brought by the Kaizen Family Trust which was demanding U$430 000 from the Rodney Dangarembizi Family Trust ruling that it was not the court’s duty to rewrite contracts between parties in business before ordering each part to settle own costs.

At the centre of the dispute between the parties lies a piece of land in Rolf Valley Township.

The parties entered into a written agreement in which Kaizen was to buy the land from the Rodney Dangarembizi Family Trust.

The purchase price was set at US$2, 5 million.

In breach, Kaizen Family failed to pay the purchase price as agreed.

On the 21st of August 2021, the parties entered into a further agreement in which a new date for the payment of the purchase price was extended by a period of forty-five days from the 10th of August 2021.

The Kaizen Family again failed to pay the purchase price in accordance with the extension of the period.

Dangarembizi, as a result, cancelled the agreement.

At the time of termination, the Kaizen Family had paid US$432 000.

Dangarembizi subsequently sold the property to a third party, for US$1, 2 million.

The Kaizen family’s claim was that it ought to be refunded the sum of US$432 000 that it paid.

On the other hand Dangarembizi Trust in its counterclaim said it ought to be paid US$868 000 being damages arising from the plaintiff’s breach.

The judge said in her view, Kaizen Family clearly admitted that it breached the contract by failing to pay the purchase price. And was now seeking a refund of the money paid towards the purchase price .

“I agree with the defendant that it is not the duty of the court to re-write contracts for the parties. In casu, the plaintiff was in breach and the defendant secured another buyer and has since transferred the property,” said the judge in dismissing the claim.

“To address issues number one and two as per the statement of agreed facts, the plaintiff in my view is not entitled to a refund of $432 000.”

She said this issue can only be scrutinised after the Dangarembizi Trust has quantified its loss if any.

The judge also said on the other hand the Dangarembizi Trust simply took mathematical figures and turned them into a claim for damages.

“What the parties ought to have done was to exchange notes on the losses, if any incurred, as the starting point. The defendant’s claim is nothing more than payback against the plaintiff.”

She ruled, “In view of the above it follows that both claims by the plaintiff and the defendant have no merit. They ought to be dismissed.”

Despite vehemently denying that there was trouble in paradise when it was revealed that she had moved out of her matrimonial home a few months ago, South African socialite Faith Nketsi has revealed a sequence of events that showed her leaving her husband and seeking help from divorce lawyers.

Nketsi revealed the tumultuous events in her relationship with embattled businessman Nzuzo Njilo during the first episode of her reality TV show, Have Faith.

The couple tied the knot in a secret wedding last year, with the ceremony covered in the reality show which seeks to show the inner happenings in the life of the socialite.

In March, it was revealed that Nketsi had decided to leave her husband, who had fallen on hard times economically.

“Since the last time you saw me, I have been adjusting to being a new mother, being a wife. I moved out of my marital home,” Nketsi says at the start of the show.

When the reality star’s mother asked her why she had deserted the couple’s Hyde Park home, Nketsi said she that their marriage was collapsing.

“What was collapsing, my whole marriage was collapsing right in front of my eyes,” she said in her video diary.

“I think at some point we all know I was going to leave the house and come back here. It is such an embarrassing situation, I’m embarrassed for my soul,” she said.

Nketsi revealed that she was seeing a therapist, as her marriage had taken a toll on her mental health.

“We need this time apart for me to make my decision,” she said.

The first episode of the reality show’s new season ends with Nketsi enquiring about divorce proceedings from her lawyer.
