Former National Social Security Authority (NSSA) chairman Robin Vela has vowed to fight what he sees as abuse of power and official overreach after a court cleared him of corruption.

The High Court last week rule that adverse findings and conclusions in a forensic audit report into NSSA covering the period January 1, 2015, to February 28, 2018, were biased, inaccurate, and incompetent.

The businessman said the judgment validated his long-standing protestations of persecution.

“I’m delighted at the finding of the Zimbabwe High Court as it completely vindicates me. The last three years of being maligned for political expediency, especially when you are a professional in the prime years of your career, who depends on reputation and integrity, have been very, very hard. My reputation has been damaged and these spurious charges have affected me both financially and emotionally,” Vela says.

He has now appointed an international team of lawyers to pursue damages against BDO International, the parent company of BDO Zimbabwe Chartered Accountants who conducted the investigation and whose conduct Justice Webster Chinamora determined “warranted censure” and against whom he awarded “punitive costs”.

“BDO International has a duty to ensure that their affiliates behave in a manner which is consistent with global auditing and accounting standards and is professional, credible and impartial,” Vela said.

“Recent events in South Africa have shown that professional services firms have a duty to behave ethically and with integrity. They cannot fob off their obligations by abrogating responsibility to local affiliates when things go wrong, but talk about a ‘global network/one firm’ when soliciting for engagement mandates. This has been established during the ‘State Capture Enquiry’ in South Africa where one of the big four chartered accountancy firms was taken to task,” says Vela.

Vela says he joined NSSA – a position he neither applied for nor courted – when asked because he “wanted to lend a hand and make a contribution towards the revival of Zimbabwe”.

He says instead of being applauded for shepherding NSSA into a strong financial position including through a merger of First Mutual and Nicoz Diamond, he was hounded out at the behest of former public service minister Petronella Kagonye to ensure only pliable board members prepared to implement and cover-up her irregular actions and abuse remained.

Vela turned to the court for relief in October last year after the now-discredited BDO Zimbabwe “forensic report” found NSSA had made investments that were not above board and had yielded losses; had concluded irregular take-off agreements that yielded losses; overpaid board fees; agreed a contract with Housing Corporation of Zimbabwe which yielded losses; and interfered in management processes. The forensic report fingered Vela, as non-executive chairperson of NSSA’s board, as being central to these “transgressions”.

He argued that the decisions attributed to him were board decisions; that the board had not acted above or beyond the scope of its mandate and had always adhered to the rules; that the losses the report identified were factually incorrect or overstated; and that the investigators had ignored or overlooked a lot of pertinent information, including High Court judgments, which absolved him from responsibility.

In a damning judgment issued on June 17, 2020, Justice Webster Chinamora agreed with Vela and found the “investigation leading to the report was biased and that the auditors did not apply their minds to issues before them”.

“It is worth emphasizing that the inaccuracies in the report speak to failure to apply one’s mind to the issues for determination before it,” Justice Chinamora wrote in his judgement.

Referring to the conduct of BDO Zimbabwe Chartered Accountants, Chinamora found that it was “within its power to eliminate some of the failure which undermined Vela’s rights”.

“In the exercise of my discretion I have decided to award punitive costs against BDO Zimbabwe Chartered Accountants,” he ruled.

Renowned economist, Gift Mugano has resigned as board chair of the Zimbabwe Iron and Steel Company (Ziscosteel) over attempts to stifle his critical views on government policy. Barely a year after his appointment in September last year, Mugano submitted his resignation on Monday.

In a letter directed to Industry and Commerce Minister, Sekesai Nzenza, Mugano expressed frustration over being criticized for expressing his opinion in public discourse by virtue of holding the highest post in a state enterprise.

“As a follow up to our conversations over my comments on public media on Government policies which are viewed by some sections of Government as in direct conflict with my role as a board member of a State Enterprise, I took a reflection of the concerns and decided to resign from the Zisco board.

“The decision to resign is built on a firm view that I believe that my contribution on the policy discourse is of primary importance which cannot be forfeited in favor of maintaining a micro role as the interim chairman and board member of ZISCO.

“For avoidance of doubt, notwithstanding the arguments that my comments are negative and retrogressive, evidence shows that in a number of times policy makers regularly took up my submissions,” read the letter.

Mugano courted the ire of the government after criticising the recently introduced foreign currency auction system. 

“The conditions of the system are a minimum of US$50,000 and maximum being US$500,000. How many companies can afford it? They will go on the black market.

“Where there is an alternative market, people usually opt for that,” he said in comments carried by the weekly Zimbabwe Independent newspaper.

In a statement seen by Nehanda Radio, Minister Nzenza acknowledged his resignation.

“On behalf of the Ministry of Industry and Commerce, the Minister would like to thank Dr Mugano for his contribution to Zisco Steel in his acting capacity.

“Going forward, the Board Chairperson responsible for leading the development of a vibrant steel strategy will be announced in due course.

“The ZISCO board is now validly constituted with a mature, diverse, and competent team of experienced professionals who individually expressed their strong desire to lead the revival of ZISCO utilising new technologies,” Nzenza added. Nehanda Radio

‘Army morale at rock bottom’

Defence minister Oppah Muchinguri sensationally told Parliament yesterday that morale among members of the Zimbabwe National Army had hit rock bottom as a result of the failing economy and that many were now tempted to engage in corrupt activities to make ends meet.

Muchinguri was appearing before the Parliamentary Portfolio Committee on Defence and Home Affairs led by acting chairperson Chiredzi South MP Kalisto Gwanetsa (Zanu PF), where she outlined a myriad of challenges soldiers are facing in the discharge of their duties, including hunger, inadequate transport and obsolete machinery.

The challenges, Muchinguri said, had also impacted negatively on efforts by the army to effectively assist the police in enforcing COVID-19 national lockdown regulations, insisting that temptations for corruption come in situations where security forces do not have food.

“As I have indicated that at our borders, we have a stretch of 3 000 kilometres and really, when you are not well-resourced in terms of transport and also food, this challenge that you mention of the allegations that you level, temptation comes in some situations,” Muchinguri said.

She was responding to allegations that soldiers and police officers were demanding bribes to facilitate passage for returnees sneaking into the country without being screened.

Home Affairs minister Kazembe Kazembe three weeks ago named the opposition, churches, civic society organisations, senior government and military officials in a plot to oust President Emmerson Mnangagwa.

There has been speculation that, Mnangagwa, who came to power through a coup in November 2017, would also be deposed through a coup by soldiers unhappy with the deteriorating economic situation in the country.

Zimbabwe is facing its worst economic situation in a decade, characterised by hyperinflation, liquidity challenges and shortage of basic goods, observers say were a result of bad governance and policy inconsistency.

But Muchinguri yesterday blamed the deplorable situation in the military barracks on sanctions, before pleading with the committee to make resources available to her ministry in order to restore the dignity of the military.

She added: “As I have already alluded to, that because we are not adequately resourced, our soldiers do not have the rations that must accrue to them, hence the temptation where they require food. We have heard about it, we are investigating to establish where this is happening.”

The Defence minister said soldiers were not only victims of hunger, but also at high risk of contracting the deadly COVID-19 as they do not have adequate personal protective equipment (PPE).

She said Treasury had not availed adequate funds to her ministry to buy PPE for soldiers.

“Constraints such as shortage of PPE are serious challenges to their effectiveness and safety. Inadequate funding for food, transport and fuel which became perennial after the imposition of illegal sanctions, also take its toll on both the morale of the troops and effectiveness,” Muchinguri, who is also the Zanu PF national chairperson, said.

“Shortage of institutional accommodation further complicates matters because under such circumstances, ZDF [Zimbabwe Defence Forces] members are supposed to stay away from their families to avoid transmitting the disease, but this is not possible due to shortage of barrack accommodation.

“The lack of a military hospital is making the situation even worse.

“To all intents and purposes, they do not go on strike when others go on strike. They are the ones brought in to bridge that gap. This is always the case especially with the Ministry of Health and Child Care medical personnel who are almost always on strike.”

Added Muchinguri: “With regards to challenges, the main challenge confronting ZDF in fighting COVID-19 is lack of resources. The scarcity of funds for normal operations of ZDF and other security arms is a matter that has been brought before this august committee many times before.

“Zimbabwe has been under economic sanctions and an arms embargo for the last 20 years. These illegal restrictions have had a negative impact on the conditions of service for members of the ZDF.

“The state of ZDF buildings and other infrastructure has deteriorated as a consequence, aged equipment, motor vehicles, arms and munitions have not been replaced for years.

“These factors have reduced the effectiveness of ZDF and other security apparatus and the advent of COVID-19 has not made matters any better.”

She said it remained a tall order to the ministry to deliver on expectations with an allocation that is hardly adequate for the soldiers’ daily routines.

“The Ministry of Defence has three main cost centres under the new budgeting framework namely defence and security, war veterans and policy and administration.

“The total annual allocated resources for these programmes in the current year are $3,112 billion. At the onset of the COVID-19 pandemic, the ZDF submitted a budget of $500 million to cover three months of COVID-19 operations, but Treasury has released about $100 million which means ZDF has had to partly finance its COVID-19 operations from its own budget.”

She said with the continuous escalation of prices of food, services and other essentials, this meant the ZDF budget could be exhausted by the mid-year.

She denied allegations that soldiers on patrol in communities where they are assisting police in enforcing lockdown regulations had become notorious for harassing and beating up people, saying the ZDF was very professional. NewsDay

Vultures are circling over MDC-T acting president Thokozani Khupe with insiders saying there is a plot to oust her by end of this month after she failed to convene an extraordinary congress (EOC) within the three months as ordered by the Supreme Court in March.

Highly-placed sources said there was a plot by party bigwigs to hand over the party leadership to interim chairperson Morgen Komichi in July in the event that Khupe fails to convene the congress.

The development came after the MDC-T was at the weekend forced to revise the congress date from September 4 to July 31.

A camp supporting secretary-general Douglas Mwonzora said Khupe had attempted to breach the Supreme Court ruling that gave her control of the opposition party.

Lawyers, who are part of the MDC-T, said failure by Khupe to hold an EOC by June 30 meant she now loses her powers to legally convene constitutional meetings, leaving Komichi in charge.

Komichi has 30 days to convene the meeting to elect the late Morgan Tsvangirai’s successor.

“On Tuesday (today), the date is June 30. It will be 90 days after the Supreme Court ordered Khupe to convene an MDC-T EOC and she has failed to do so.

“Attempts to hide behind the Supreme Court practice direction will not hold. It is not applicable as it only affects time count to the court. This means court processes of matters still pending before the court and not those already decided,” a lawyer said.

He said Khupe can’t claim practice directive when she has been benefiting from the effects of the Supreme Court ruling from the day it was issued.

“You can’t have a selective effect of the judgment because Khupe has been acting president of the MDC-T for the past three months owing to that ruling and she wants to conveniently say the practice directive suspends the implementation of the judgment only as far as holding congress is concerned yet she is implementing all other parts of the judgment,” he said.

Law lecturer, Valentine Mutatu said Khupe’s team was wrong in the reading of the practice directive, adding that if she failed to hold the EOC by June 30, she would lose control of the elective processes to Komichi.

“The practice direction was specific on the issues it covered. At law, there is a practice we use, that is, the exclusive mention of issues is the exclusive exception of other issues.

“In this case, the practice directive by the Chief Justice exclusively mentioned the judgments that were suspended, which were in line with government policy on rentals and sales and not the judgment as issued by the Supreme Court,” he said.

Mwonzora, during a standing committee meeting two weeks ago warned that failure to convene an EOC within three months would expose the party to lawsuits which could be disastrous.

“The Supreme Court sets clear deadlines for this event,” Mwonzora said.

“We have developed the roadmap to the congress. The correct interpretation of the Supreme Court judgment means that the congress must be held by July 31. Any extensions outside the timelines given by the Supreme Court can expose us to unnecessary legal challenges,” Mwonzora told the meeting.

MDC-T deputy spokesperson Khalipani Phugeni, however, insisted that Khupe remained in charge and was within the correct interpretation of the Supreme Court ruling because of the practice directive issued by Chief Justice Malaba.

In an affidavit he filed at the High Court through his lawyer Addington Chinake on Friday, Chihuri accused Matanga of wanting to destroy him to facilitate his own rise within the force.

“My family home was burnt beyond recognition.

“The fire was started in my home office burning all files, records, 15 bibles, etc were destroyed. “To make sure that the records and files were destroyed, he took a 20-litre diesel container and another container with oil.

“He sprayed both in the office, the main bedroom as the major target and so he did the rest of the house except the guest wing.

“Maukazuva [the constable] is facing serious criminal charges, two attempted murder charges and one of arson and malicious injury to property,” Chihuri said.

Chihuri is on the verge of losing his business properties to the state after allegations that he amassed the wealth through corrupt means.

When Chihuri’s property caught fire, reports claimed that there was gun-fire and a shoot-out.

Some reports also claimed that a fight broke out among police officers guarding Chihuri’s house and a shoot-out ensued.

Rogue police officers allegedly attempted to set the house on fire. Fortunately, an emergency response by an army helicopter and the Fire Brigade managed to put out the fire.

Hardlife Maukazuva was charged for the incident, faced three charges including unlawful entry, malicious damage to property and attempted murder.

According to the state, he broke into Chihuri’s house and looted some property before he burnt down a wing of the property.

While the house was on fire, it was alleged that he fired thirty rounds of bullets at his colleagues who had come to attend the scene. The incident occurred on December 6, 2017. Nehanda Radio

Former Police Commissioner General, Augustine Chihuri has deposed a sensational affidavit in the High Court claiming that President Emmerson Mnangagwa forced himself on his then pregnant wife during the liberation war before making sure the pregnancy was terminated.

Chihuri is on the verge of losing his business properties to the state after allegations that he amassed the wealth through corrupt means. High Court Judge, Justice Felistas Chatukuta granted an application by prosecutor-general Kumbirai Hodzi for an order forcing Chihuri and his wife, Isobel Halima Khan, to explain how they acquired their properties as part of a process to seize them.

On Friday Chihuri responded by filing an affidavit at the High Court through his lawyer Addington Chinake claiming Mnangagwa was persecuting him because of this strained relationship.

During the last days of Mugabe’s regime at the centre of factionalism in the ruling Zanu PF, there was a divided state security with the police headed by Chihuri supporting the then president Mugabe and the military supporting then vice president Emmerson Mnangagwa, now President.

Chihuri added that problems started when he got married the “Zanu way” in Chimoio in Mozambique before the then political commissar, mayor Urimbo (late), around 1976 and the following year, his wife became pregnant.

“The current president of Zimbabwe, Mr Emmerson Dambudzo Mnangagwa, was aware of this union and pregnancy. Using his position, my then-wife was transferred to Shai Shai in Mozambique where Mr Mnangagwa had a forced affair with her as she alleged.

“I tried to terminate the marriage, but the political commissar (Mayor Urimbo) threatened me not to dare to do it, citing that Mr Mnangagwa [as he then was] is a dangerous man and would behead me as he was not hesitant to kill.

“From then my relationship with the president of Zimbabwe worsened. He went on to suggest that my then-wife terminate the pregnancy. God was on my side, it was tried and it failed.

“The late Cde Serbia, who was working under Mr Mnangagwa in the security department, told me about the termination of the pregnancy and that Mr Mnangagwa vowed that as long as he lived, I shall pay for not giving up on my then-wife to him.

“Cde Serbia warned me again to keep quiet or else I would perish and never see the light of day.” Chihuri said the dispute between the two has since been turned into a “national spectacle for the purpose of victimisation.

“One can clearly see how the public media in the country has been reporting about me and my family, wife and children that we have been targeted for annihilation,” he said.

Former Police Commissioner General Augustine Chihuri has rubbished claims that he wanted to arrest former army commander General Constantino Chiwenga, now vice president, at Robert Gabriel Mugabe International Airport as he returned from China on November 12 during the genesis of the military intervention that ousted the late former president Robert Mugabe.

Speaking for the first time in exile via court affidavits, Chihuri said it was a lie told to Chiwenga by Godwin Matanga, who would become the new police chief following the military coup.

In his fight to stop attempts to seize his properties over alleged corruption, Chihuri through his lawyer Addington Chinake, on Friday filed a court challenge and in the affidavit described his alleged persecution following the coup and accused Matanga in particular of harassing his family.

President Emmerson Mnangagwa’s administration has accused Chihuri of siphoning millions of dollars from the Zimbabwe Republic Police (ZRP), money which was mysteriously transferred to companies linked to his family or associates.

Chihuri added that an ‘unexplained wealth order’ issued on June 12 which required him to prove his innocence against alleged criminal activity violated his right to presumption of innocence until proven guilty, guaranteed by section 70 of the constitution.

“Matanga went on to lie to the then CDF (Chiwenga) that I wanted to arrest him upon his return from China at RG Mugabe Airport. This was not so but blatant lies to sow seeds of division and hate between me and the then CDF.

“Godwin Matanga did all this to secure his position. Godwin Matanga has made all sorts of allegations against me, lying shamelessly,” read Chihuri’s court documents.

The court documents filed by Chihuri have also exposed corruption and nepotism in Zanu PF administration.

He defended his wife who was a supplier for the ZRP and said the same contracts were awarded to Jocelyn Chiwenga who supplied the ZRP with traffic police sleeves and Mary Chiwenga who was the government’s travel agent.

In the application also filed on behalf of his wife, children and five companies, Chihuri added that, “by allowing the court to make an ex parte order which is final in nature against the applicants without affording them a right to be heard, section 37B(1) of the Money Laundering and Proceeds of Crime Amendment Act violates the applicants’ right to protection of the law as enshrined in section 56(1) of the constitution… and the right to a fair hearing as enshrined in section 69 of the constitution.

“By limiting itself only to people who hold property whose value is greater than US$100,000, section 37C(1) of the Act unfairly and discriminately targets the applicants on the basis of their social and economic status in violation of section 56(3) of the constitution.

“Section 37(B)1 as read with section 371 of the Act violate the applicants’ property rights as enshrined in section 71(2) of the constitution by taking away their liberty to deal with their property as they please on the basis of an unexplained wealth order which was filed, heard and granted in breach of the audi alterum partem rule,” Chihuri added.

Already under High Court orders to explain where he found the money to buy a swathe of properties, Chihuri was recently ordered to explain why he allegedly transferred US$10.4 million of police money to a company owned by relatives of a former colleague. Nehanda Radio

The leaner cabinet is composed of a prime minister and 15 ministers. They have the task of turning around the country’s economy, security and improving relations with its neighbours, especially Rwanda.

Burundi’s top diplomat to the UN Albert Shingiro was named to the foreign affairs ministry.

Former police chief Gervais Ndirakobuca has been named the minister for interior and security.

Mr Ndirakobuca and Prime Minister Alain-Guillaume Bunyoni were sanctioned by the US and EU for their suspected role in violence and human rights violations during unrest in 2015 – when the then president, the late Pierre Nkurunziza, pushed for a third term.

Five women have been appointed to posts in the ministries of justice, labour, trade and tourism, social affairs and human rights, and communication.
