The legal representative for embattled South African TV presenter and musician, Molemo “Jub jub” Maarohanye, has cast doubt on accusations made by several high-profile women who claim he sexually assaulted them, saying if that had been the case they would have reported years earlier when the alleged incidents are said to have occurred.

The rapper made his appearance at the the Johannesburg Magistrate’s Court on Monday morning.

Jub Jub, who was arrested in July and is facing 13 charges, including rape, attempted murder, assault and kidnapping, has so far denied all charges.

Some of the incidents are said to have happened over two decades ago.

After his latest appearance in court, Jub Jub’s defence Advocate Terrence Baloyi said if the complainants understood the seriousness of the charges they were bringing forward, they would have brought them forward a long time ago.

“We are talking about something that happened 20 years ago, I still maintain that if the plea was that serious, it should have been brought earlier. I’m wondering if the state has a strong case against us because in an issue where they say “a life being in danger” why wait so long?”

The matter was postponed to 5 February to allow for further consultation between the defence and client.

The defence team, said Baloyi, had requested further particulars because it could not comprehend some of the charges levelled against Maarohanye, adding that he is hopeful the state would provide enough information.

“The main point of contention is that we had requested further particulars which were furnished this morning, as a result we do not know whether we have been provided with everything we requested.

“We need to consult. Justice delayed is justice denied, we’re being delayed but hopefully they have provided us with everything we need to proceed with the matter.”

Loliwe no more: South African singer Zahara dies in Joburg hospital

After over two weeks battling liver complications, South African singer Zahara (35) (real name Bulelwa Mkutukana) has reportedly died at a private hospital in Johannesburg this Monday night just before 9pm.

According to a report by Sunday World her fiance Mpho Xaba was by her bedside.

“The family will release a statement soon. She was with Mpho when she passed away,” the source told the publication.

Zahara’s cousin Oyama Dyosiba who is the spokesperson for the Mkutukana family said he was struggling to locate Xaba on Monday night.

“I am getting calls from everywhere. I am in Cape Town and I am doing my best to get hold of Mpho. I can’t get hold of him,” he added.

Zahara had been admitted in a Johannesburg hospital for the past fortnight with a liver ailment, with the family releasing a statement last week that they wanted privacy while she received treatment.

“Unfortunately, even though our daughter’s hospitalisation has been of strict confidentiality within our family and close friends, that hasn’t stopped the spread of disingenuous information on the internet.

“We want to stress that any reliable information regarding Zahara’s health will be communicated via her official social media platforms or by herself,” the family said at the time.

According to publication Zimoja, things have not been rosy behind the scenes, with Xaba reportedly changing an agreement made in which only himself, Zahara’s mother Nokhaya, her two sisters and brother were allowed to visit her in the ICU at a private hospital.

“This week an angry Xaba told hospital management and doctors treating Zahara that only himself will visit her, claiming her family wants to control everything yet they won’t pay for her hospital bills.

“Zahara family has been banned from visiting her after he overheard them discussing unsettling money issues yet they won’t pay for urgent medical procedures that need to be done to save her. Mpho put his foot down and said he’s Zahara husband,” the source said.

Wicknell Chivayo spoils himself with US$500k G Wagon on his birthday

While he is still celebrating his victory in the Supreme Court 10 days ago, which brought to an end a five-year battle with the Zimbabwe Power Company (ZPC), flamboyant businessman Wicknell Chivayo spoiled himself with another luxury vehicle, this time a Mercedes Benz G Wagon worth US$500 000.

Chivayo, who has been on a spending spree recently, shelling out gifts to everyone from comedians to Zanu-PF supporters, did not forget to reward himself on his special day, purchasing a brand new Mercedes Benz G 63 Brabus.

Posting on X, formerly Twitter, Wicknell wrote:

“Thank you for all the wonderful birthday messages last week, the love was overwhelming and i felt really special. To add on to your love I decided to spoil myself and buy this beautiful birthday present for 500k USD a BRAND SPANKING & STINKING NEW 2023 BENZ G 63 BRABUS.🙏🙏🙏.”

According to Benzinsider.com, Wicknell’s new toy, described by the Benz enthusiasts as “masterpiece of engineering, requires even the wealthy to dig deep in their pockets as it comes at quite a cost.

Chivayo has hogged the limelight recently, as his long-running case against ZPC reached its climax.

In early December, the tycoon and his company Intratrek Zimbabwe  (PVT) LTD won a case at the Supreme Court which the ZPC had filed an appeal against his earlier victory.

Justice Lavender Makoni sitting with Justice Joseph Musakwa and George Chiweshe all unanimously concurred and dismissed the ZPC appeal for lack of merit and upheld the High Court judgement by Justice Paul Siyabonga Msithu handed down in January this year after a fully contested trial in September 2022.

While the businessman is certainly not holding back on buying luxury vehicles, many are now putting pressure on him and his company to deliver on the Gwanda Solar Project, whose contract was the subject of the court case in the first place.

The High Court has freed opposition Transform Zimbabwe (TZ) leader Jacob Ngarivhume after the state failed to provide evidence to support its claim that he posted a message of X (formerly Twitter) inciting public violence.

The court quashed Harare magistrate Feresi Chakanyuka’s ruling saying the state did not link Ngarivhume to the Twitter account in which the message was posted.

Chakanyuka sentenced him to an effective three-year sentence. He has spent 8 months in prison.

Ngarivhume was arrested in 2020 and charged with inciting public violence after he allegedly used his X account to mobile mass protests against corruption.

Ngarivhume was jointly charged with opposition stalwart, Job Sikhala, who has been in jail for more than a year.

Speaking to Studio 7 today at Harare Magistrate Court, Amalgamated Rural Teachers Union of Zimbabwe, President, Obert Masaraure, said Ngarivhume was not supposed to be in jail.

Masaraure further said freeing Ngarivhume implies that Sikhala too may be acquitted.

Ngarivhume was represented by Professor Lovemore Madhuku and Moses Nkomo, instructed by the Zimbabwe Lawyers for Human Rights.

Last month, Ngarivhume successfully applied to have High Court judge Justice Benjamin Chikowero to recuse himself from presiding over his bail application pending appeal. VOA Zimbabwe

Court declares King Misuzulu’s recognition by Ramaphosa as unlawful

The Gauteng High Court, Pretoria, has set aside King Misuzulu KaZwelithini’s recognition by President Cyril Ramaphosa, declaring it unlawful and invalid.

King Misuzulu ascended to the throne of the Zulu nation last year after the death of his parents, King Goodwill Zwelithini, and his mother, Queen Regent Mantfombi, who died months apart in 2021.

King Zwelithini died in March, while the Queen Regent Mantfombi died in May.

A meeting held in May 2021 was held by the Zulu Royal family, where the name Misuzulu emerged as the successor. Prince Simakade did not attend, but he sent a letter, apparently showing no desire for the throne.

In October, King Misuzulu’s brother, Prince Simakade, approached the Pretoria High Court, seeking the court to declare Ramaphosa’s decision to issue the certificate of recognition to King Misuzulu irrational and asking it to set aside the decision.

Ramaphosa told the court that his decision was rational in issuing the certificate to King Misuzulu, thus paving the way for his October 2022 coronation.

He also told the court he had been guided by a February 2022 ruling in the KwaZulu-Natal High Court in Pietermaritzburg, where Judge Isaac Madondo dismissed an application by Prince Mbonisi who wanted King Misuzulu’s coronation to be stopped on the basis that King Misuzulu was wrongly nominated and there is a pending dispute that should first be resolved.

Prince Simakade’s legal team wanted the meeting to be declared unlawful as it was improperly attended by people who were not members of the Zulu royal family.

Judge Norman Davis said the decision to issue King Misuzulu with a certificate of recognition was unlawful and invalid and was set aside.

Judge Davis added: “The matter of the recognition of the Isilo of the AmaZulu is remitted to the first respondent (Ramaphosa), who is directed to act in terms of Sections 8(4) and 8(5) of the Traditional and Khoi-San Leadership Act 3 of 2019 and to appoint an investigative committee as contemplated in that Act to conduct an investigation and to provide a report in respect of allegations that the identification of the second respondent (Misuzulu) was not done in terms of customary laws and customs.

“The first respondent is ordered to pay the applicants’ costs of their applications, including the costs of two counsels, where employed”.

SILLY SEASON: Mthuli Ncube named ‘African Finance Minister of the Year’

LONDON – There is laughter, mockery and anger all round after Finance Minister Professor Mthuli Ncube was named the “African Finance Minister of the Year” by a UK based organisation calling itself Reputation Poll International.

“Today, I was greatly honored to be awarded an accolade of the African Finance Minister of the Year by the Reputation Poll International in the United Kingdom at the 2023 Global Reputation Forum in the House of Lords in Central London,” Ncube announced.

Reputation Poll International chairman, Lord John Waverly justified the award saying;

“In today’s rapidly evolving financial landscape, the convergence of technology and banking has given rise to a new era of financial management challenges and the Zimbabwean Minister, with a shoe-string budget, managed to fight the Covid-19 pandemic with the Government and country recording minimal Covid-19-related human deaths.”

But back in Zimbabwe the award has been met with both laughter, ridicule and anger. Writing on X (formerly Twitter) journalist Hopewell Chin’ono was the most blunt.

“Then we got the most anti-people national budget that Zimbabwe has ever had, and the Finance minister Mthuli Ncube insults the whole country by posting a silly tweet saying that he won the Finance Minister of the year award from some bogus communications company.

“He has the nerve to post that crap on X when he is presiding over the worst economy in the world by inflation rates, Zimbabwe has the highest inflation in the world authored by his misguided and corrupt policies!

In another separate Tweet Chin’ono added; “How much did you pay Reputation Poll International for this one? The same organization that declared (Lazarus) Chakwera one of Africa’s top leaders. You are a joke Mthuli.”

Former Citizens Coalition for Change (CCC) spokesperson Fadzayi Mahere, now the MP for Mt Pleasant, was equally scathing in her assessment of Ncube.

“Mthuli Ncube is the worst Finance Minister Zimbabwe has ever had. ♦️Anti-people Budget, ♦️Triple digit hyperinflation, ♦️49% extreme poverty, ♦️Ballooning debt crisis, ♦️Dead Zim Dollar, ♦️Broken economy, ♦️Scavenging Treasury, ♦️Hut tax, ♦️Stealing exporters’ proceeds, ♦️More tax, Exchange rate confusion, ♦️Rejected by Cowdray Park, ♦️2% tax, ♦️Lied that he built donor clinic, ♦️Gold leakages, ♦️ZiG, ♦️Even more tax. He’s failed. It’s a mess. He must resign. #MthuliTheWorst.”

It’s not the first time Ncube has been given an award that has drawn mockery.

In 2021, he was ranked among the top five Ministers of Finance in Africa by the Senegalese publication “Financial Afrik.”

That year former Finance Minister Tendai Biti described Ncube’s celebration of the award as disturbing and sycophantic, emphasising the poor state of the economy in Zimbabwe.

He was backed by Tony Hawkins, a former economics lecturer at the University of Zimbabwe’s Graduate School of Management, who said with high inflation rates and unachieved targets, there was little for Ncube to celebrate.

Zanu PF on cusp of two thirds majority after snatching 7 seats from CCC

BULAWAYO – Zanu PF claimed seven of the vacant nine National Assembly seats to get to within three seats of a two thirds majority in parliament.

The ruling party also gained four council seats – three in Bulawayo and one in Masvingo – in elections marred by low voter turnout.

The by-elections were called after Sengezo Tshabangu, styling himself as Citizens Coalition for Change (CCC) interim secretary general, recalled MPs and councillors elected in the August 24 elections, claiming they had ceased to be members if the party.

The recalled MPs said Tshabangu was an impostor, and had filed papers to stand in Saturday’s election but a court ordered their names removed from the ballot on Friday night.

Two candidates that Tshabangu fielded won in Lobengula-Magwegwe and Mpopoma-Mzilikazi constituencies in Bulawayo.

In Bulawayo South, Zanu PF’s Raj Modi won the seat with 1,608 votes with James Sithole, a Tshabangu aligned CCC candidate, getting 1,130.

In Lobengula-Magwegwe, Tendayi Chitura Nyathi of CCC Tshabangu polled 1,648, beating Zanu PF’s Menziwa Dube who got 1,318.

The Mpopoma-Mzilikazi seat was won by Charles Moyo (CCC Tshabangu) who polled 1,632 against Zanu PF’s Karamba Dzingai who got 1,097 votes.

In Beitbridge West, Thulani Ndou (Zanu PF) won by 4,929 against his challengers who failed to garner anything meaningful.

Zanu PF’s Arthur Mujeyi won the Cowdray Park seat with 1,765 after defeating Vusumuzi Chirwa (CCC Tshabangu) who got 1,560. There were 572 spoilt votes.

In Binga North, Zanu PF’s Chineka Muchimba was declared winner with 9,882 with Judith Sibanda, a candidate from the Tshabangu aligned CCC getting 1,004.

In Lupane East, Zanu PF’s Phathisiwe Machangu got 6,863 votes, beating David Nyathi (CCC Tshabangu) who got 1,750.

In a council by-election in Masvingo, shot-lived city mayor Shantiel Hwata polled 585 votes and could not upstage Benson Hwata of Zanu PF who got 612.

Raunchy dancer and musician Sandra Ndebele of Zanu PF was elected Bulawayo Ward 20 councillor with 1,106 votes beating two CCC candidates Simbarashe Dube who got 782 and Michael Gumede who polled 57. ZimLive

Israel-Hamas war: Ceasefire in Gaza chances shrinking, Qatar says

Israel’s bombardment of Gaza is “narrowing the window” for a new truce, the Qatari prime minister has said.

Speaking at the Doha Forum, Sheikh Mohammed bin Abdulrahman al-Thani said Qatar would continue its efforts to pressure both sides into a ceasefire.

The gulf state played a key role negotiating the week-long pause in violence at the end of November, which allowed the release of hostages.

Israeli PM Benjamin Netanyahu said on Sunday “the war is in full swing”.

He said in recent days “dozens of Hamas terrorists” had surrendered, and were “laying down their weapons and handing themselves over to our heroic fighters”.

“This is the beginning of the end for Hamas,” he said.

The comments come as the humanitarian crisis in Gaza continues to worsen.

On Sunday afternoon, the Hamas-run health agency in Gaza said almost 18,000 Palestinians had now been killed.

In an audio message to Al Jazeera, Hamas’s armed wing said the temporary ceasefire had “proved its credibility” and that no more hostages would be freed until Israel engaged in talks.

In the message, spokesman Abu Ubaida also said Hamas fighters had fully or partially destroyed 180 military vehicles and killed “a large number” of Israeli soldiers, and that it is still inflicting blows on Israel, and “what is coming is greater”.

At the conference in Doha, Philippe Lazzarini, the head of UNRWA, the UN agency for Palestinian refugees, said the area had become “hell on earth” and was “definitely the worst situation I have ever seen”.

Also speaking at the conference, Palestinian PM Mohammad Shtayyeh said Israel “should not be allowed to keep violating international humanitarian law”, and called for international sanctions.

Mr Shtayyeh represents the Palestinian Authority, the organisation which operates in the West Bank and which is separate to the Hamas government operating in Gaza.

As the meeting took place in Doha, in the south of Gaza fighting continued to rage.

The city of Khan Younis, the place people were told to head to to escape the fighting in the north, is now under heavy bombardments – with Israel asking civilians to leave its centre.

Speaking to BBC News, senior Israeli adviser Mark Regev said there was going to be “difficult fighting” in Khan Younis, and urged civilians to “move to safe zones” – with Israeli tanks reaching the centre of the city on Sunday evening.

Civilians in the city have been pictured collecting bodies and mourning family members killed in fighting.

When asked about the situation in what Israel calls safe areas, Mr Regev said his country has made a maximum effort to try to safeguard civilian lives.

Civilians in Gaza have formerly been advised to make their way to a “safe zone” at al-Mawasi. Measuring just 8.5 sq km (3.3 sq miles), the area is smaller than London’s Heathrow Airport, has few buildings and largely consists of sandy dunes and agricultural land.

Meanwhile, Israel has also been engaging in international diplomacy – calling out its allies for an inconsistent approach.

“You cannot on the one hand support the elimination of Hamas and on other pressure us to end the war, which would prevent the elimination of Hamas,” said Mr Netanyahu while briefing his cabinet.

He was speaking two days after 13 members of the UN Security Council supported a resolution calling for an immediate ceasefire, with the US vetoing the move and the UK abstaining.

Israel also denied a claim by UNRWA chief Mr Lazzarini that it was trying to force Gazans out of the region and into Egypt – something previously reported in Israeli media.

The World Health Organization has also taken the unusual step of passing a resolution calling for immediate medical access to Gaza, with its director-general earlier calling the situation in the area “catastrophic”. BBC News

DRC president Felix Tshisekedi compares Rwanda’s Kagame to Hitler

The Democratic Republic of Congo’s leader has taken his rhetorical attacks on his Rwandan counterpart to another level by comparing him to Adolf Hitler.

Félix Tshisekedi said Paul Kagame was behaving like Hitler, and added: “I promise he will end up like Hitler”.

Mr Tshisekedi who is campaigning for re-election, was addressing a rally in Bukavu, close to the Rwandan border.

He has often accused Rwanda of backing rebels in the east of his country, which it has always denied.

The spokesperson for Rwanda’s government described the Congolese president’s comments as “a loud and clear threat”.

With the vote less than two weeks away, Mr Tshisekedi is trying to win backing for a second term. Despite attempts to quell the violence, which has included ceasefire deals and the presence of regional and UN troops, who are now leaving, insecurity is still rife in the east of the country.

A multiplicity of armed groups have caused mayhem, including Tutsi-led M23 rebels, who Mr Tshisekedi has said are supported by Rwanda.

A UN group of experts made a similar observation in a report released earlier this year with the US backing its findings.

The M23 has been seizing Congolese territory forcing hundreds of thousands of people to flee their homes.

Speaking on Friday night, Mr Tshisekedi said to supporters that he would tell Mr Kagame that “since he wanted to behave like Adolf Hitler by having expansionist aims, I promise he will end up like Adolf Hitler.

“However, he [has] met his match, someone who is determined to stop him and protect his country.”

Hitler, responsible for the deaths of millions, including six million Jewish people in the Holocaust, ended up taking his own life in a bunker in the German capital, Berlin, in 1945.

His efforts to expand German territory led to World War Two.

Mr Tshisekedi has previously described the Rwandan leader as “the enemy of the Democratic Republic of Congo”. In a BBC interview last year, he said their relationship was “cold for lack of a better word. It is he who unfortunately decided to attack the Democratic Republic of Congo”.

Mr Kagame has always dismissed such talk in the past, accused Mr Tshisekedi of being a “war monger” and instead focussed on another rebel group in the east of DR Congo – the Hutu-led FDLR – which Rwanda sees as a threat.

In her message on X, formerly Twitter, responding to the Hitler remarks, Rwandan government spokesperson Yolande Makolo said it was “a loud and clear threat by the DRC president, in a context where the FDLR is more armed than ever”.

Mr Kagame has been the dominant political figure in Rwanda since the end of the 1994 genocide, in which about 800,000 people were slaughtered by ethnic Hutu extremists targeting the Tutsi minority. BBC News

The escape route for the CCC remains forming a new party now – Mliswa

35

Filing papers again under CCC when you had just been recalled by Tshabangu stands as a very dumb move. Simple logic showed that Tshabangu would simply come again and block the candidates. Politics doesn’t work well with emotions. It needs a rational and dispassionate approach.

You don’t just plunge headlong, blinded by emotions and excitability inspiring yourself with end-time messages in a secular matter. That won’t work. Now CCC finds itself where ZANU-PF really wanted it. Cornered, divided and dazzled.

The escape route remains forming a new party now. It was even better done earlier before the disembowelment got this bloody but the oft stated emotions blocked any logic. With each new Tshabangu punch it’s clear the disdain to form a new party is mere obstinance not strategy.

Again CCC is failing to appreciate instances of the law against those of politics. You can never win law cases whilst parroting political mantras before Judges. In some cases accusations of captured courts are randomly thrown when the opposition has simply failed to do its job.

CCC leaders should simply be held to account for some of the blunders and unstrategic moves which have made the party a defenceless sheep. While the party has been under attack its leaders have made the situation even worse through not-so-brilliant decisions and moves.

In a normal country they should even consider resigning to maintain integrity. I challenge them to resign. When the initial recalls began they should have had all MPs and Councilors resign in protest and that was more strategic and powerful before the party became a dead weight.

They could have contested as independents caucusing together as a party. They didn’t take heed. Resultantly many are realizing how most of the politicians are simply there for their stomachs. All talk of protecting gains is convenient balderdash in the larger democracy war.

Temba Mliswa is the former Independent MP for Norton and also a former member of the ruling Zanu PF party.
