The Zimbabwe Association of Doctors for Human Rights (ZADHR) yesterday threatened to slap the PHD founder with a lawsuit within seven days because his HIV/Aids treatment claim is dangerous and leaves patients prone to infection.
This comes after the popular preacher told multitudes at his Waterfalls church on Sunday that he had found a cure for HIV/Aids and cancer but said patients will not be required to stop taking their anti-retroviral drugs.
In a letter to Magaya, ZADHR chairperson Brighton Chizhande told the cleric that his actions are in contravention of the Medicines and Allied Substance Act (Section15:03) and Part 3, Section 32 of the Public Health Act.
“We write to seek an urgent retraction of your claim to cure HIV and Aids.
“We also demand an immediate halt in the distribution, selling and marketing of any products that mislead the public as to be of curative effect towards HIV and Aids.
“As ZADHR, we give you notice to take remedial action within seven calendar days of this notice by withdrawing all products that purport, claim or infer that they cure HIV and Aids from the market forthwith and making a public statement that withdraws your initial claim to have found a cure for HIV.
“Failure to reasonably make these remedial actions will inevitably lead to ZADHR filing a legal suit against you and your ministry; as such malicious claims pose an existential danger as defined in the Public Health Act,” Chizhande wrote.
He said while ZADHR has no dispute with innovation in discovery of drugs, they argue that due process of proving clinical efficacy and safety prior to any advertisement and distribution is of paramount importance.
On Tuesday, the government also warned Magaya that he risks being arrested if he goes ahead and starts selling his controversial HIV/Aids herbal medicine without regulatory approval.
Meanwhile, the World Health Organisation (WHO) has dismissed Magaya’s claim arguing that there is no known cure for HIV infection.
In a statement, WHO representative to Zimbabwe Alex Gasasira said to date, there is no known and proven cure for HIV infection, but effective treatment exists to manage the infection through antiretroviral therapy and drugs.
He added that any new drug should go through clinical trials to be rigorously evaluated and to determine whether they are safe and effective in the prevention or treatment of any ailments.
“Any researchers involved in developing possible new treatments for any ailments, including HIV and Aids are reminded to subject these to the ministry of Health and Child Care (MOHCC) national clinical trial processes and procedures,” he said.
Besides stirring anger among Western medical experts who said Magaya was giving false hope to the sick, the Health ministry pointedly pooh-poohed his claims and any suggestions that he had the support of the government or might have got approval for his organic medicine.
Gasasira said use of antiretroviral treatment, in line with national guidelines, has resulted in better health outcomes for people living with HIV and encouraged people to continue taking their medication. DailyNews

The nasty brawl over the control of President Emmerson Mnangagwa and his government — driven by narrow economic interests — is threatening to paralyse both the State and the ruling Zanu PF.

And such is the ferocity of this crass war over resources, involving top Zanu PF officials and powerful businesspeople, that fears are growing that it could result in the kind of horror State capture show as has been exposed in neighbouring South Africa.
This comes as businessman Kudakwashe Tagwirei — who has interests in agriculture and energy — has come under increasing scrutiny from various quarters over his dealings with the government.
This week alone, Tagwirei was in the spotlight again after he and his partners — Singaporean multi-national company Trafigura — released 100 million litres of fuel to the government under a one-and-a-half year agreement which, in total, will eventually see Zimbabwe receiving one billion litres of fuel.
Zanu PF insiders who spoke to the Daily News yesterday said they feared that the “war for resources” — which was manifesting itself in “brazen attempts to capture the State” — could shatter the ruling party and also derail government’s push to turn around the country’s sickly economy.
One of the sources said the recent war of words which had broken out between Tagwirei and the chairperson of the Zimbabwe National Liberation War Veterans Association (ZNLWVA) Christopher Mutsvangwa — over the control of the country’s lucrative fuel industry — was part of the wider fight for control of the State.
“This titanic war is murky, dirty and far wider than the control of a fuel pipeline … There are four known groups which have emerged in Zanu PF, and which are fighting, together with their business associates, for the control of the State and the country’s resources.
“So, the fight to decapitate Tagwirei and his partners has little to do with improving the country’s economy … it is about all these groups fighting to secure a position at the top table,” the source said.
“These four groups include people who lost in the Zanu PF primary elections, those who won in the primary and national elections but were overlooked by Mnangagwa in his Cabinet choices, as well as some of the old guard who think age is no longer on their side and others who see themselves as kingmakers and consisting of relatives, a permanent secretary and former Cabinet ministers,” the source added.
“What makes this whole thing more confusing is that although Tagwirei has been outed as having captured the State — and he is part of one of the groups fighting for supremacy in the country — the government continues to deal with him as evidenced by this week’s fuel deal,” the source said further.
Meanwhile, war veterans jumped into the fray yesterday, demanding to have a stake in the country’s fuel industry.
This came just days after they petitioned Mnangagwa to sack former Cabinet ministers that he re-assigned to the Zanu PF headquarters, after he dropped them from his new Cabinet team.
The war veterans accuse the under-fire party bigwigs — who include secretary for administration Obert Mpofu and fellow politburo members David Parirenyatwa, Patrick Chinamasa and Sydney Sekeramayi — of undermining Mnangagwa, engaging in corrupt activities and sabotaging the president’s efforts to revive the country’s economy.
Of particular concern to the war veterans is Mpofu’s recent statement in which he said Finance minister Mthuli Ncube had not consulted party bigwigs when he unveiled his controversial austerity measures — which include the much-criticised two cents per dollar transaction tax.
Interestingly, Ncube went on to hire controversial former Zanu PF youth official William Gerald Mutumanje, also known as Acie Lumumba, to head a communications committee — in a move which backfired spectacularly after the maverick activist took to social media to attack Tagwirei and the Reserve Bank of Zimbabwe.
As a result, four RBZ directors were subsequently suspended pending investigations.
Another Zanu PF source said Mpofu and his colleagues were being targeted because they were allegedly part of “Tagwirei’s consortium” — with the businessman further said to have recently bought luxury vehicles for several ruling party bigwigs and senior government officials.
“We are arranging for a meeting of war veterans this week and I can tell you there is nothing wrong with us getting involved in the mainstream economy.
“The war veterans are against the monopoly that has been established by a corrupt cartel and we want that to end.
“As war veterans we are very much united and Mutsvangwa is still our chairperson. Others now have various responsibilities but otherwise we are more united than ever,” said Mashonaland Central province war vets chairperson Sam Parirenyatwa.
He also denied that the war veterans were taking sides with Mutsvangwa, who it is claimed, is fighting to push out Tagwirei in favour of South African company Mining, Oil and Gas Services.
War veterans spokesperson Douglas Mahiya also said there was nothing wrong with the former freedom fighters going into business.
“There are some people who want to ring fence their interests and now they are targeting war veterans. If I may ask, what is wrong with war veterans supplying fuel? Is fuel made in Zimbabwe or it is imported?” Mahiya asked rhetorically.
Interestingly, the Zanu PF youth league took an opposing position in the matter, warning party bigwigs yesterday against fighting Tagwirei.
Youth league boss Pupurai Togarepi said people should not “mistake Statecraft and State capture” — adding ominously that “the door is ever open for all those who feel bigger than the party”.
“We are … concerned at the extent of indiscipline and irresponsibility which is now being unfortunately stirred by some persons who all along we thought had the national interest at heart, but as things are turning out, are only interested in lining their pockets.
“There has been a lot of nonsense from otherwise respected individuals who are trying to put a wedge between the president and his two deputies through making sensational corruption stories which have no grain of truth in them.
“The youth league stands ready to defend the values of our great party and we will, if need arises, ask the party to take disciplinary action against loose cannons from the party, regardless of one’s political station or role.
“We are against factionalism and would want those who are trying to bring us back to the Robert Mugabe era of divisions to be punished accordingly,” Togarepi said in an apparent attack on Mutsvangwa. Daily News
An illegal gold panner from Filabusi who fatally stabbed his girlfriend in a fit of rage following an undisclosed dispute, was yesterday sentenced to 13 years in jail.
Themba Mahlaba (36) of Sapila village under Chief Maduna area had a dispute with Ms Sibusisiwe Moyo (42) resulting in him throwing his spear and stabbing the woman.
The deceased was inside her makeshift structure near J Z Moyo High School in West Nicholson area of Gwanda.
Bulawayo High Court judge Justice Nokuthula Moyo convicted Mahlaba of murder with constructive intent.
In passing sentence, Justice Moyo condemned Mahlaba’s conduct, saying the courts have a duty to protect the sanctity of human life.
“The accused person started at the deep end. He is a first offender who started with a very serious charge. The courts frown upon any loss of life through violence,” she said.
The judge took into account the fact that Mahlaba had already spent six years in custody awaiting trial.
“A life was unnecessarily lost due to accused person’s unwarranted behaviour. The courts have a duty to uphold the sanctity of human life through passing deterrent sentences,” said Justice Moyo.
Prosecuting, Mr Thompson Hove said on November 4 in 2011, the deceased was at Umzingwane River near J Z Moyo High School where she was selling her wares to illegal gold panners with her sister, Ms Sibongumusa Moyo.
The court heard that at around 9PM, Mahlaba visited the deceased at her makeshift structure. The two, who are also cousins, had a misunderstanding over an undisclosed issue.
“Tempers flared and the accused person stormed out of the deceased’s tent and went to look for his spear. He returned armed with a spear and threw it towards the deceased’s tent and in the process struck her on the back of her left shoulder,” said Mr Hove.
The court heard that Mahlaba rushed to the scene and pulled the spear out of the woman’s body.
The deceased screamed prompting Sibongumusa to rush to the scene and render first aid.
Sibongumusa, with the assistance of another illegal gold panner identified as Mr Tinashe Sibanda, secured a vehicle and they escorted the deceased to Gwanda Provincial Hospital.
She was transferred to the United Bulawayo Hospitals (UBH) where she succumbed to the injuries a week later.
According to post mortem results, the cause of death was septic shock, peritonitis, penetrating stab wound to the chest and homicide.
Sibongumusa, in her evidence, told the court that the accused person came to her tent at night and collected his spear before he proceeded to the deceased’s place where he allegedly stabbed her.
“I heard my sister screaming and calling out my name and when I went to investigate, I found her lying in a pool of blood while the accused person stood by holding his spear. I then took a piece of cloth and bandaged her before I went to a nearby village to look for transport to ferry the deceased to hospital,” she said.
Another witness, Mr Kholisani Mkandla, said the deceased and the accused person were lovers. He said on the day in question he overheard Mahlaba insulting the deceased and accusing her of belittling him.
Mahlaba through his lawyer, Mr Prince Butshe Dube of Mathonsi Ncube Law Chambers, said he was drunk on the fateful day and could not recall what transpired.
He told the court that when he threw the spear, his intention was to thrust it into the ground near the deceased’s tent for safe keeping. The Chronicle
The National Railways of Zimbabwe (NRZ) is re-introducing the commuter passenger trains in the city, starting with the City-Cowdray Park route on Monday next week.

Commuters will pay 50 cents per trip compared to kombis that charge between 75 cents and $2 depending on demand.
The development is expected to cushion members of the public from the high transport costs. The NRZ said it added about four kilometres on the previous City-Luveve route, to cater for passengers in the new suburbs.
In statement, the NRZ said the commuter train will operate two services between Bulawayo Station and Esigodweni in Cowdray Park in the morning and in the evening from Monday to Friday. There will be no train during the weekend.
NRZ Public Relations Manager Mr Nyasha Maravanyika said the fare is pegged at 50 cents for a single ride.
“Only cash payment will be accepted for single ride tickets and purchases can be made either before boarding or while on board the train. Commuters can also buy 10 multi-ride tickets for $4,50,” he said.
Multi-ride tickets can be bought using swipe or Ecocash at the Bulawayo Station.
Services on other routes, said Mr Maravanyika, will be introduced in due course.
“The morning commuter train will depart Bulawayo Station at 4:05AM and arrive at Esigodweni at 5:30AM. It will depart at 5:35AM and arrive at Bulawayo Station at 7AM,” said Mr Maravanyika.
“The evening service will leave Bulawayo Station at 5.30PM and arrive at Esigodweni at 6:50PM. It will depart for the return trip at 6:55PM and arrive at 8:15PM.” The Chronicle
Afro-Pop songstress Ammara Brown has dropped her much-anticipated video for song Svoto that features Nigerian singer, Mr Eazi.

Svoto is a love song with a vibrant, energetic vibe and a traditional African sound infused with a sungura beat.
After the single’s release in August, the track trended because of its cover where Ammara was captured standing while doing a 180 degree split which most felt was difficult to imitate.
A challenge was initiated with people being challenged to pose like her creating excitement around the song.
Also, the fact that she collaborated with Mr Eazi, a Nigerian whose music is loved by many locally, worked in her favour.

A man from Bulawayo who was arrested for the rape and brutal murder of a woman from Cowdray Park suburb on Monday last week, has been linked to a string of rape, unlawful entry and theft cases around the city.

Peter Nyathi (29) was arrested on Monday at Bulawayo Prison where he had started serving a 10 months prison term for unlawful entry and theft which he committed in Shangani, Matabeleland South.
He allegedly supplied a false name and was convicted as Mthulisi Nyathi to avoid being identified as a convict who had absconded a number of cases in the courts.
Police sources said after he allegedly raped and bludgeoned Shilla Moyo who was coming from fetching firewood with her neighbour, Nyathi moved to Shangani where he committed the crime which landed him in jail.
Moyo died two days after being attacked at Mpilo Central Hospital where she had been admitted with police linking Nyathi to her death.
Sources said Nyathi has been linked to a series of rape, unlawful entry and theft cases in Cowdray Park and Luveve suburbs.
“He actually has a warrant of arrest at West Commonage Magistrate Court after he disappeared while he was on bail. We suspect he is responsible for breaking into several houses and raping women in bushy areas between Cowdray Park and Luveve suburbs,” said the source. “Tomorrow he may be put on parade where victims may identify him. He actually confessed to raping women who did not report the cases and police are following up on that.”
Bulawayo police spokesperson Inspector Precious Simango said it was too soon to comment on Nyathi’s other crimes.
She, however, confirmed that Nyathi was arrested at Bulawayo Prison where he was serving a sentence for unlawful entry and theft.
“We’ve arrested a 29-year-old man in connection with the murder of a woman from Cowdray Park suburb which occurred on Monday last week. As detectives were conducting their investigations, they got wind that a well known criminal had been seen near the site where the deceased’s body was found,” said Chief Insp Simango. She said the investigating officers tracked down the suspect to where he stayed with his live-in girlfriend in Cowdray Park.
Chief Insp Simango said the girlfriend revealed to the officers that on the day Moyo was attacked, Nyathi arrived with blood stained clothes and told her that he was injured before disappearing.
She said on Thursday, detectives who were following up on the case learnt that he could have been hiding in Shangani.
“When the officers arrived in Shangani, they discovered that the accused had been arrested and taken to court where he was sentenced to 10 months in prison for unlawful entry and theft. The detectives followed him up to Bulawayo Prison where he had started serving his sentence leading to his arrest.
He is assisting police with investigations,” Chief Insp Simango said. Nyathi could be linked to several crimes and police were yesterday verifying his involvement in the criminal activities.

Three people died on the spot after being hit by vehicles in three separate accidents in Hwange and Lupane last Thursday and Sunday night, police confirmed.
Matabeleland North police spokesperson Chief Inspector Siphiwe Makonese said the three accidents could have been avoided by observing road traffic rules.
The first accident occurred near Halfway in Lupane district when Phosani Nkomo (18) from Siachilaba under Chief Saba in Binga was hit by a haulage truck on Thursday last week.
Nkomo was travelling from Binga to Bulawayo in a C.A. G bus which had stopped at a lay-by for a health break. He was hit by a Zambian registered truck driven by Mr Hamasumo Emil (33) from Choma as he tried to cross the road into the bush.
Nkomo was putting on ear phones and could not hear the haulage truck’s horn as well as other passengers’ warning. “Upon reaching the 219km peg, the driver of the truck which was going towards Bulawayo observed a stationary bus facing the same direction but had stopped for recess.
One of the passengers emerged from the left side of the road trying to cross to the other end as the truck was overtaking. He had ear phones and couldn’t hear the sound of truck and other passengers alerting him,” said Chief Insp Makonese.
He died on the spot from injuries on the head and leg.
Chief Insp Makonese said the driver of the truck did not stop immediately.
The truck, which was carrying 33 tonnes of cobalt hydroxide, was later found parked on the roadside about 4km away. Mr Emil later surrendered himself at Hwange Traffic police.
The other two accidents occurred on Sunday night, one near Hwange town and the other one near Victoria Falls.
Mafa Nyathi (43) from Chief Nekatambe area in Binga was hit by an Extra City bus with 60 passengers and driven by Mr Stewart Mundapanzira just after midnight about 10km outside Hwange town.
Chief Insp Makonese said Nyathi was crossing the road when he was hit.
Fifteen kilometres out of Victoria Falls, Learnmore Muleya from Monde under Chief Mvuthu was also hit by a small car that was driving towards the resort town just after midnight.
The driver was Mr Simbarashe Mabhodo of Victoria Falls who police said was dazzled by bright lights from an oncoming haulage truck. The Chronicle
A seven-year-old Victoria Falls girl who was allegedly raped by her cousin a year ago, used a suggestion box to report the assault.
The girl had, through her teacher, reported the sexual assault to her parents but no action was taken.
The complainant was allegedly raped by her 25-year-old cousin at the family home in Victoria Falls sometime last year.
She reported the rape to her class teacher in March this year during a lesson on child abuse.
The teacher (name withheld to protect the toddler) advised the girl’s parents and they decided to protect the abuser, hence the rape was not reported to the police.
Seeing that no justice had been done, the girl wrote a letter which she put in a suggestion box at her school two weeks ago.
After seeing the lettter, the headmistress Mrs Chido Maringanise reported the rape to the police, leading to the accused’s arrest.
Police spokesperson for Matabeleland North province Chief Inspector Siphiwe Makonese confirmed the arrest of the suspect on Tuesday.
“On an unknown date and time last year the accused called the complainant into one of the bedrooms where he raped her once. The girl didn’t tell anyone about the issue,” said Chief Insp Makonese.
“On March 1 this year after a child abuse lesson at her school, she revealed the rape to her class teacher who advised her parents. The parents decided to protect the abuser hence they did not report the rape to the police. On 17 October, the girl wrote a letter and put it in the school’s suggestion box which was then seen by the school head who made a report on Tuesday,” said Chief Insp Makonese.
The complainant was taken to Victoria Falls Hospital for medical examination while her cousin was arrested.
Chief Insp Makonese said investigations are in progress and the accused is expected to appear in court for rape.
She bemoaned moral decay in society where cases of child abuse are mostly committed by relatives and trusted guardians.
Chief Insp Makonese appealed to stakeholders to play a part in fighting abuse, and praised the brave girl for taking it upon herself to expose the crime after being empowered with information.
“As police we work in collaboration with other stakeholders including teachers and parents when it comes to children protection because it’s everyone’s responsibility.
“We want to applaud the little girl for standing for her rights and advise all children not to be afraid of disclosing any form of abuse. The school head did well by reporting the crime which was almost swept under the carpet because we want a free and conducive environment for children at home, school and even in the streets. We appeal to parents not to entrust children’s custody to anyone even if they are relatives,” said Chief Insp Makonese.
Meanwhile, Hwange district recorded a general increase in cases of abuse between January and September this year compared to the same period last year.
Attempted rape of adults and kids cases rose from nine to 24 while cases of sex with juveniles rose from 126 to 147. Fifty cases of rape of adults were recorded up from 34 while child rape cases fell from 139 to 117.
Twenty cases of indecent assault on adults were recorded up from nine while those on minors were 22 up from 21. Three children suffered aggravated indecent assault compared to two last year. The Chronicle
American missionary died in northwestern Cameroon after being shot in the head on Tuesday amid fighting between armed separatists and soldiers, the director of the regional hospital said.
Charles Trumann Wesco, a missionary from the US state of Indiana who had been in the region for two weeks, was rushed to the hospital in Bamenda after he was gravely wounded while in his car, hospital director Kingue Thomson Njie said.
“He died in our hospital after all attempts to save his life,” Njie told The Associated Press.
Wesco’s wife and eight children were still in Bamenda, he said. It was unclear if any of them were harmed or if someone else was with him in the car.
Bamenda was in Cameroon’s Northwest Region, the restive English-speaking area where armed separatists have been fighting to create an independent state. Fighting between armed groups and the military is ongoing.
Regional Govenor Deben Tchoffo said armed groups staged attacks to stop the reopening of the University of Bamenda, and the military fought back Tuesday. He said Wesco might have been caught in the crossfire.
Military spokesperson Colonel Didier Badjeck told the AP the military killed at least four suspects in Wesco’s death and arrested many others. He did not specify if the people detained were military personnel or separatists.
Cameroon’s military said last week after launching attacks on suspected separatist training grounds that “many have been killed.” The attacks happened the day after President Paul Biya was declared the winner of a seventh term.
The increased violence began after the government clamped down on demonstrations by English-speaking teachers and lawyers protesting what they called their marginalisation by Cameroon’s French-speaking majority.

The World Health Organisation (WHO), which is responsible for prequalifying medicines before use, has said the only legalised and tested remedy available for HIV clients is antiretroviral therapy.

This follows claims by Prophetic Healing and Deliverance (PHD) Ministries leader Prophet Walter Magaya that he has found the cure for HIV which has claimed millions of lives the world over. Scientists have spent the last three decades trying to find a cure for the pandemic which affects about 1,3 million Zimbabweans and so far only ART has been proven to suppress the amount of virus in the body.
In a statement in response to questions from The Chronicle yesterday, WHO said no one has approached the international body about any treatment to cure HIV.
“There are standard procedures and guidelines for WHO prequalification of medicines which are available to the public. A lot of research is going on in this area but none has demonstrated a cure for HIV among humans,” read the statement. “Therefore, there is no cure for HIV, although antiretroviral treatment can control the virus, meaning that people with HIV can live long and healthy lives. Once someone stops taking the treatment, the virus re-emerges.
Therefore, no one should stop taking their medicines for HIV treatment.”
United Nations Zimbabwe communications specialist Mr Sirak Gebrehiwot added that there is no known and proven cure for HIV to date. “Zimbabwe has very well-established procedures for clinical trials.
Clinical trials are the process by which any new medical approaches including drugs are rigorously evaluated to determine whether they are safe and effective in the prevention and/or treatment of any ailments,” he said.
“The United Nations in Zimbabwe wishes to remind and encourage any researchers involved in developing possible new treatments for any ailments, including HIV and Aids to subject these to the Ministry of Health and Child Care national clinical trial processes and procedures,” added Mr Gebrehiwot.
An HIV and Aids activist Mr Dumisani Nkomo urged authorities to subject Magaya’s claims to the usual tests.
“The Ministry of Health and Child Care and the National Aids Council should test his herbs for efficacy. He should be given a chance and until authorities research on his product, they should not dismiss him,” said Mr Nkomo.
In a statement the Zimbabwe Hospital Doctors’ Association said Mr Magaya’s claim will have far reaching repercussions if people pin their hope on his statements.
“We wish to advise relevant authorities that Press statements alone are not enough to restore sanity on this subject. We say so because such Press statements may not reach all the people.
Mr Magaya should be asked to publicly reverse and retract his utterances in the manner that he first announced the subject,” said ZHDA spokesperson Dr Mxolisi Ngwenya.
“Until such a time that the robust and rigorous research is done, with enough medical clearance and verification through animal studies, Mr Magaya’s new drug should be quarantined and isolated from humans. Life is too precious.
We encourage all clients to adhere to all their medication as per doctor’s prescription,” he said.
The only human who was cured of HIV is Mr Timothy Ray Brown who underwent a bone marrow stem cell transplant in 2007.
Mr Brown’s procedure almost cost him his life twice and scientists the world over are closely monitoring a rare genetic mutation in the person who donated bone marrow to Mr Brown which may have had a central role in his cure to formulate a cure for HIV.
The Pharmaceutical Society of Zimbabwe weighed in saying Zimbabwe has made great strides towards reducing new HIV infections, reducing HIV prevalence, prevention of mother to child transmissions and promoting safe and responsible health seeking behaviour and the medical claims (on HIV cure) have a potential to reverse the hard earned gains aimed at the eventual eradication of the disease.
“Given this background PSZ would like to caution opinion leaders to desist from misleading the public with unsubstantiated claims. We call for responsible leadership and following of due processes necessary for any innovation within the medical fraternity,” said the PSZ in a statement. The Chronicle
