Nkosilathi Dube, of House number 33 Vundu Flats, pleaded guilty before Bulawayo magistrate, Mr Gideon Ruvetsa, for contravening section 67 of the Criminal Law (Codification and Reform) Act Chapter 9:23, indecent assault.

It is the State’s case as presented by Mr Marvin Nzombe that on 22 December this year at around 2:30 pm, the complainant (name withheld) went to Tilus Wholesalers located in the city centre for shopping. While in the shop, one of the workers advised all the customers to stand close to each other in the queue.

The court heard that the complainant stood in front of the accused person, Dube, where she felt something behind her was pressuring into her buttocks.

She turned back to see what was going on but she just assumed it was an aerial which the accused person was holding. However she decided to move to the other queue but the accused person followed her.

The court further heard that the complainant heard something again pressing her buttocks and she turned back to find out that Dube was behind her busy using his magical powers to abuse her. She then asked him what he was doing behind her but denied doing anything.

It is said some men who were in front of the complainant lifted up Dube’s trousers and saw his man hood protruding. Some people started meting out instant justice on Dube by beating him before he was taken to Bulawayo Central Police Station leading to his arrest.

In passing the sentence, the magistrate said indecent assault was a serious offence and as such it calls for a deterrent sentence.
