HARARE – Media personality DJ Ollah 7 walked away a free man on Monday afternoon after the National Prosecuting Authority of Zimbabwe (NPAZ) declined to go ahead with a case of cyberbullying and harassment filed against him.
Ollah was hauled before the courts on Monday after his arrest on Saturday for inflammatory comments by one of his guests, rapper Holy Ten, against Mudiwa Hood.
In a statement, the NPAZ said Ollah was not answerable for statements made by his guest.
“Prosecution has been declined against Owen Madondo (DJ Ollah 7), accused of cyberbullying Mudiwa Hood. The case arose from statements made by guest Mukudzei Chatsama (Holy Ten) during a podcast, which were alleged to cause distress and humiliation to Hood.
The NPAZ determined that Madondo, as the podcast host, lacked intent to harass or bully, as the statements were made by his guest during a live broadcast,” the NPAZ said in its statement.
Despite Mudiwa expressing his desire to withdraw the charges, the NPAZ said the final decision rested with them.
“While the complainant expressed a wish not to pursue the matter further, the Prosecutor General has the final authority in deciding whether charges are withdrawn, in accordance with NPAZ Prosecutorial Guidelines.
“Victims of crime or complainants do not have the power to end criminal court processes–this decision rests with the Prosecutor General,” the statement read.
Meanwhile Ollah has denied posting an apology to various people his podcast is said to have offended while he was in police custody.
In a widely circulated letter on social media, Ollah was purported to have apologized to Ambassador Uebert Angel while also assuring his audience that he will no longer provide a platform to people who engage in personal attacks.
The prominent podcaster was arrested after inflammatory statements were made by controversial rapper Holy Ten.
In the letter Ollah also apologised to Mudiwa, Winky D, Mama Vee, Kimberly Richards, Voltz JT, and everyone else attacked by Holy Ten on his podcast.
Speaking to media, Ollah’s legal representative Dumisani Mthombeni, insists the statement did not come from his client.
“DJ Ollah 7 has been in police custody at Harare Central Police Station since Saturday. He has not had access to his social media accounts, and we have not issued any instructions for an apology to be posted,” said Mthombeni.
