MDC-T leader Douglas Mwonzora’s manoeuvres to position himself as the main opposition leader suffered a double blow last week after the United States and the European Union (EU) signalled that they consider his ascendancy as lacking credibility.

Mwonzora took over from Thokozani Khupe as interim leader of the MDC-T after the party’s chaotic extraordinary congress last December.

President Emmerson Mnangagwa’s government regards Mwonzora as the head of the official opposition ahead of MDC Alliance leader Nelson Chamisa after a series of controversial court rulings that allowed the MDC-T to elbow out their rivals from their offices and elected positions.

In a new report on the human rights situation in Zimbabwe, the US said Mwonzora’s “minor” political party was the beneficiary of court rulings that disenfranchised voters.

“The High Court, in a series of decisions beginning in March, paved the way for a minor political party, the MDC-T, to challenge the leadership of the main opposition party, the MDC Alliance, ignoring earlier jurisprudence that ruled that political parties, as private and voluntary associations, should resolve their differences using internal remedies,” the US report read in part.

“This decision disenfranchised voters by allowing the minor political party to recall and replace elected MDC Alliance parliamentarians and local councillors.

“In June police and military arrested some and blocked other senior MDC Alliance officials from entering the party’s headquarters when MDC-T party members broke into the building.”

The damning report was a blistering attack on Mnangagwa’s human rights record with accusations that state security agents were being used to target government critics for abductions and torture.

Mwonzora says he wants to introduce a new kind of politics in Zimbabwe, which promotes dialogue and has been gravitating towards a working relationship with Mnangagwa’s government.

Last week’s developments, however, pointed to lack of trust by the international community with the EU delegation reportedly pointing out to the MDC-T that it has questions about its status.

Mwonzora was told in no uncertain terms that his claim to be the main opposition leader in Zimbabwe was dubious during a March 31 virtual meeting with EU heads of mission, multiple sources that followed the proceedings have told The Standard.

“The envoys told Mwonzora that they had challenges recognising him as the face of the opposition because he did not participate in the 2018 elections as a presidential candidate,” said the official, who requested to remain anonymous.

“The two parties, however, agreed that broad-based dialogue should include Chamisa.

“It has been a long-held EU position that dialogue in Zimbabwe be broad-based and includes the MDC Alliance.”

Mwonzora’s spokesperson Lloyd Damba, who described the meeting with the EU as cordial, refused to comment about the allegations that the envoys queried their claim to be the official opposition party.

Damba referred all questions to the EU.

“We issued a statement on our meeting with the EU,” he said. “If you have any doubts on what transpired, did you make an effort to reach out to the EU?”

Timo Olkkonen, the EU ambassador to Zimbabwe, was not available for comment yesterday as his mobile phone was unreachable.

Last week, Olkkonen only described the meeting as “an extensive and interesting discussion”.

In March last year, Mnangagwa’s Political Actors Dialogue (Polad) platform was told that the west had expressed reservations about supporting any dialogue platform that excluded Chamisa.

“Although they applaud and appreciate the great initiative taken by His Excellency ED Mnangagwa and the political leaders that participated as presidential candidates in the 2018 harmonised election, that of coming together to establish Polad, they are all of the view that the ongoing dialogue process should rather be broad-based, with key stakeholders that include the MDC Alliance, civic society, religious groups, white commercial farmers and business included,” Khupe, who represented Polad’s international relations committee, said at the time.

“Both the US and EU ambassadors emphasised their desire to have South Africa playing a leading role in the dialogue process with former president Thabo Mbeki as the mediator.”

The MDC Alliance says the MDC-T is being used by Mnangagwa to decimate the opposition and create a one-party state.

On the other hand, Mwonzora says he is the legitimate successor to MDC founding leader Morgan Tsvangirai.

Mnangagwa’s third-term bid is a constitutional impossibility: Mwonzora

Opposition leader and constitutional lawyer Douglas Mwonzora has asserted that Zimbabwe's Constitution is designed to make it extremely difficult for anyone to amend and extend the presidential term limit. "So, if people want the incumbent to benefit, in this particular case, President Mnangagwa, then there must be another referendum in which the referendum question is simply that should President Mnangagwa have a third term or not. It will be a person specific. "Now, these referendums must not be within six months of each other. They must be more than six months of each other. So, it is almost an impossibility," Mwonzora stated.

Njabulo.libertyatliberty at gmail dot co.In my opinion,l think the judgement by the Supreme Court of Zimbabwe was fair to the MDC leaders.Given that there was a wrestle for power and the issue was a stalemate at that point. The only solution was for the matter to be resolved by the court ,since the parties involved in that dispute could not come to a agreement as to who was to be the legitimate or substantive President of MDC .All parties were afforded the opportunity to make their submissions in the court.Advocate Chamisa made his submissions in the court too.He was not denied that opportunity.Dr Khuphe too was afforded the same opportunity. Therefore, based on that reasoning and reality ,there was fairness in terms of being granted the same rights to use the courts.Of course, the expected standard of the courts ,is that they have to be competent and be based on the principle of impartiality .And be based on the principles of ,”reasonableness ,fairness and being just”.If those principles are void ,then the justice system in question would be having a “black hole”.lt is normal in all cases outcome, for the party who lost the case to blame the courts or to express their discontent about the outcome. That is also the right of that party to those proceedings to express their thoughts or discontent of that outcome ,if it is not favourable to them. However, people must know that the purpose of remitting a case to court ,is to find a legal solution which is binding to all parties and others involved. No political party or any authority or individual or institution or organisation and /or company can overturn a court decision. If they wish to do so,they have to apply for leave to the court ,challenging or appealing against that decision. For example, one can appeal against ‘an error of law’ or against a sentence imposed against them,if they reasonably believe that it is disproportionate with the crime that they were convicted for. So,all the parties in that case were afforded that opportunity. So,in my opinion the Supreme Court judgement was fair, reasonable and just to all parties.Remember that ,MDC had robbed Dr Khuphe of her right to take over as the acting President of MDC ,as was legally supposed to be the case. So,that had to be determined by the court ,since she(Dr Khuphe),was not happy with being ousted of her rightful position. So,after the court’s binding decision,it was all up to Advocate Chamisa and Dr Khuphe to follow the instructions of the court .The parties involved in that case were all given an opportunity to contest for the position of the substantive President of MdC ,in order to replace the late ,Dr Richard Tsvangirai. However, the court cannot or could not put anyone under duress to participate in the Extraordinary Congress which was purposed to elected a substantive President of MDC.Dr Khuphe ,Advocate Chamisa or any other party ,had a choice to participate or not to participate. Thus because the court’s decision was for the election of a substantive MDC President ,but not for compelling the parties to take part in that contest. But,all were compelled to ensure that the instructions were followed.Whosever decided not to contest ,did that at their own behest. So,Advocate Chamisa opted to abstain. And nobody must blame him for not taking part in those elections. On the other hand nobody must blame Dr Khuphe for participating in that election .Equally ,nobody must blame Munozorwa and other candidates that participated in that Extraordinary election .I am not going to give my opinion on whether the Extraordinary Congress election was held fairly or not.But ,the main issue ,is that the court order was effected. So,for the USA or EU or UK ,to now say that that was defrenchising people,l personally do not think it is right.l think it’s an unfair attack on the incumbent MDC President (Munozorwa). Thus because he only followed the Supreme Court ruling.Whether there was any motivation from ZANU Pf for that Extraordinary Congress election to take place, that is totally immaterial .Assuming Advocate Chamisa had opted to participate in that Extraordinary Congress election,my assumption ,is that he would have won in that election. So,nobody must blame anyone for that decision by the Supreme Court.Equally, nobody must now blame the incumbent MDC President (Munozorwa),because he only followed a legitimate court order.Whether he robbed Dr Khuphe and others in that election,is another issue to be determined by the courts ,but not the social media or any person. The complaining candidates have to adduce their evidence in court ,as they make their submissions to the court. So,the USA,UK and the EU has no jurisdiction over that matter.Of course, they can comment on that issue. But,they do not have any right to impose any laws or rules on how the opposition parties must be administered. The issue of Human Rights ,is of course important. But ,who tells those countries about the human rights violations that they are unleashing against the black folk in their jurisdictions?.Please do not misconstrue this to be that l am trying to justify Human Rights abuses by any political party in Zimbabwe.Human Rights ,is a universal concept. And as such must be effected indiscriminately .But,at the moment,it seems like when the white supremacists in those countries violate the human rights of the black folk in those countries,African states are not allowed to question that. The African states are gagged by being bribed with Covid 19 experimental drugs ,not to complain about any human rights violations taking place in those countries. The African states must ask those countries too ,about those human rights violations .Blacks in those countries get killed everyday .Blacks in those countries do not have equal opportunities in their courts or are not treated as equals to whites .Or ,they are not even allowed to fight for their rights there .That also include freedom of expression which is suppressed by those white supremacists jurisdictions. So,why are they blaming the new MDC President and trying to use Human Rights as a premise to blame him?.Why can’t they remove the spec in their eyes first before removing the one in the eye of a black person?.I think Africans must just keep quiet and ignore them when they make such silly complaints.African states must just apply an equal measure to those whites that violate the human rights of other Blacks in those countries. So,that they feel how it is like to violate the human rights of others.Yes!,Africa must not violate the human rights of its people, but when those countries ask on such issues, they too must be asked the same questions on their human rights violations. This issue of bribing African countries with fake Covid 19 drugs, is the one that makes African states not to question those white supremacists. If those countries genuinely wants to help reduce the high mortality taking place in African states, they must provide or donate drugs that are very essential to Africans. For example, cancer drugs, drugs for helping people with chronic diseases and/or gadgets such as x-ray machines(and other scanning machines). Those are life serving things ,not all this Covid 19 fake drugs .People in Africa don’t have Covid 19,its just a fear that was installed in the African minds by the whites from those whites supremacists jurisdictions.
So,those countries must stop meddling in the political affairs of those opposition parties. On the issue of recalling MPs ,l will not comment on that. Thus because some of our people are not yet enlightened on crucial issues regarding politics. They believe when you make a comment ,one must always favour the opposition parties or favour the ruling party. That is their problem. When l make a comment on an issue l try to be impartial .Remember, not everyone is into politics .Not everyone identifies to opposition parties or the ruling party. But just because politics is inevitable and invincible to us all, hence we have to express our thoughts on political issues .
