Brothers fight over late father’s estate

Two Zvishavane siblings are locked in a legal wrangle with their half brother over the sharing of their late father’s estate.

Hamadziripi Maranda through his lawyers, Mutendi, Mudisi and Shumba Legal Practitioners, filed summons at the Bulawayo High Court citing his step brothers Henry and Isman as defendants.

Hamadziripi, Henry and Isman were beneficiaries of their late father, Mr Meadison Maranda’s estate.

Mr Maranda died in October 2011 resulting in his estate being shared among his sons.

In terms of the first and final liquidation and distribution account, the trio was each allocated 33,3 percent in Bedford Mine situated in Zvishavane.

In papers before the court, Hamadziripi accuses his two half brothers of deliberately sidelining him by excluding him from the shares.

“The defendants have not given me my shares since October 2013. I made a court application to compel Fidelity Printers to disclose how much gold the mine has produced during that period, upon the application being granted, I realised that the mine generated $146 772 from July 2014 to December 2015,” said Hamadziripi.

He said he was entitled to $48 875, but the defendants have despite demand refused or neglected to give him his share.

“The defendants, jointly and severally, the one paying the other to be absolved are liable to pay me $48 875 being my shares of proceeds from Bedford Mine for the period stated,” said Hamadziripi.

The defendants have not yet filed a notice to enter an appearance to defend the summons and they have 10 working days to do so. Chronicle
