A VICTORIA Falls woman who beat up her husband when he asked for a divorce stunned a magistrate when in a fit of rage she rejected community service and demanded to be sent to jail.
Taken aback by the strange request, Victoria Falls resident magistrate Sharon Rosemani on Tuesday told Brinter Moyo, 22, she would spend one day in prison holding cells to decide if she really wanted to go to prison.
The magistrate had convicted Brinter of physical abuse for bashing her husband, Dumisani Moyo, 33.
On the following day, Brinter whose night in the slammer had apparently convinced her to revise her hasty decision, opted for community service.
She told the court she could not bear the environment in prison.
“I don’t think I will be able to stay in prison Your Worship. Please, have mercy on me. Let me perform community service instead of staying in jail,” Moyo pleaded.
Rosemani sentenced her to three months imprisonment wholly suspended on condition she performs 105 hours of community service at the Registry offices.
Asked why she assaulted her husband, Moyo said:
“I didn’t mean to beat him or cause any harm to him. I was overcome by anger and couldn’t control myself after he questioned why I bought groceries and shoes instead of giving him the money to go and buy beer,” she said.
Prosecuting, Takunda Ndovorwi told the court Moyo assaulted her husband following an argument about divorce and money.
“On September 22 at around 2PM while at their matrimonial home, the accused struck her husband with a log after the two had long argued about divorcing each other.
“Brinter had bought shoes and groceries that morning and her husband, Dumisani Moyo, questioned her decision and told her she should have given him the money to buy beer,” said the prosecutor.
The court heard Brinter was angered by her husband’s love for beer and started insulting him before striking him with a log several times on the head and on the left arm.
The matter was reported to the police, leading to Brinter’s arrest while her husband was referred to hospital. A medical report was produced in court showing that Moyo sustained injuries on the head and arm. The Chronicle
