Jailed serial rapist, Robert Martin Gumbura’s application for discharge has been dismissed by the Magistrates Court.
Gumbura’s bid to be spared prosecution in fresh charges of rape hit a snag when his application for discharge was thrown out.
In the fresh charges, Gumbura is being jointly charged with his secretary, Tendai Ganyani.
Presiding magistrate, Ms Fadzai Mthombeni said during assessment, the courts looked at the credibility of the evidence submitted by state witnesses in denying Gumbura’s application.
The court also took into consideration the issue of sexual intercourse which is not being denied by the accused.
The state told the accused to wait for the court’s ruling.
The duo’s lawyers, Advocate Thembinkosi Magwaliba and Ms Rekai Maposa of Maposa, Ndomene and Maramba Legal Practitioners, made an application for discharge at the close of the state case.
