Through their lawyer Mr Archbod Madzima, the trio argued that they have been on remand for a long time and advised the State to proceed by way of summons. However, the State, led by Miss Sharon Mashavira, opposed the application on the basis that a pathologist’s report needs to be filed pending service of indicts from the court.

She said the trio was facing a serious and a complex offence hence it was not in the interest of justice to grant their application. Harare magistrate Mr Tendai Mahwe conceded with Miss Mashavira’s submissions and remanded the matter to January 6 next year.

Miss Mashavira alleges that Magorimbo was murdered after failing to pay DJ Munya US$5 000 compensation for having an affair with his wife. The trio were granted US$300 bail apiece on June 13 by High Court judge Justice Joseph Musakwa.

Magorimbo allegedly paid DJ Munya US$1 000 in February through Janhi and Matare as part payment of the US$5 000. DJ Munya commissioned Janhi and Matare to deal with Magorimbo after he had become evasive over the outstanding payment, the court heard.

In May, the group human resources director of Magorimbo’s employer, Premier Services Medical Investments, David Mandishona, allegedly received a text message demanding a US$5 000 ransom for the release of Magorimbo who had disappeared, the court heard.

On the same day, DJ Munya allegedly went to Magorimbo’s residence where he assured the deceased’s wife Millicent that her husband would return the following day, ordering her not to report to the police.

The following day Magorimbo showed up naked and staggering, his hands tied with a shoelace, and collapsed as he approached the ground floor of his flat, the court heard. Magorimbo was rushed to West End Hospital in Harare where he was diagnosed of poisoning and died the same day.
