Magaya’s Planet Africa sued over $40 000 debt

A cable manufacturer and supplier has filed a lawsuit in the High Court against Planet Africa, the holding company of Prophetic Healing and Deliverance (PHD) Ministries founder Walter Magaya, for alleged breach of terms.

The Zimbabwe Stock Exchange-listed Cafca Limited, which manufactures over 900 cabling products,  claimed Magaya’s Planet Africa had failed to make a $40 000 payment and have indicated they will continue to default on their obligations.

In a filing dated November 28 by Cafca lawyer Wellington Magaya of Coghlan, Welsh and Guest, the amount should have been paid upon delivery of appliances.

Between August 23 and September 2, Planet Africa allegedly made several purchases and took delivery of electric cables.

“Sometime in August 2016, plaintiff and defendant entered into an agreement for the supply of electric cables on credit,” the summons read.

“Plaintiff and defendant entered into agreement in terms of which plaintiff was to purchase electric cables on credit.

“In terms of the agreement, all purchases were supposed to be paid for within 30 days from date of purchase.

“In breach of the agreement between the parties, plaintiff failed to make full payment within 30 days leaving a balance of $42 477,37 outstanding.”

Cafca is now demanding the full amount owing to them as well as for Magaya to pay the full legal costs incurred in the suit. Daily News

HARARE - The trial of PHD Ministries leader Prophet Walter Magaya, who is facing four charges of rape among others, failed to kick off on Monday as prosecutors and defence lawyers argued over whether to have an open trial or have witnesses testify via video.
