Zanu PF chairman wants to divorce wife of 32 yrs

Zanu PF national chairman Simon Khaya Moyo is seeking to divorce his wife of 32 years on the grounds that the marriage had irretrievably broken down and there were “no conjugal rights enjoyed between the parties.”

Its reported “On August 23 this year, Moyo filed divorce summons at the High Court through Manase and Manase Legal Practitioners against his estranged wife Mrs Sibonokuhle Getrude Moyo (nee Ngwenya).”

In the plaintiff’s declaration, Moyo’s lawyers indicated that the marriage had irretrievably broken down. “There is no more love and affection between the parties. There are no conjugal rights enjoyed between the parties.

“The marriage relationship has failed to live up to a relationship, which is a normal one and as expected in marriage relationships,” read the declaration.

The couple were married under the Marriages Act on August 30 1980 at Bulawayo Magistrates’ Courts. The union was blessed with two children Khanyisa Khaya Mduduzi Moyo (born on 7 July1982) and Langa Mandlenkosi Khaya Moyo (born 4 April 1986).

During the subsistence of their marriage, the couple acquired the following properties:

  1. Edenvale Farm, Mangwe District
  2. 150 herd of cattle and various farm implements.
  3. Number 14406 Inkakha Circle, Selbourne Park, Bulawayo
  4. Number 26 Rolf Avenue Chisipite, Harare
  5. Toyota Hilux in the custody of Mrs Moyo
  6. Various household furniture at Number 14406 Inkakha Circle Selbourne Bulawayo.

Khaya Moyo says he wants the Chisipite property and is offering his wife the rest of the listed properties. He suggested that the Bulawayo house should be donated to their son Langa while Mrs Khaya Moyo is allowed to enjoy lifetime use of the house.

Since Mrs Khaya Moyo was offered the bulk of the property including the farm, 150 cattle and all the implements, Khaya Moyo says he will not pay maintenance after the divorce. He also argues that there were no longer minor children in the marriage.

Mrs Khaya Moyo is yet to respond to the divorce application.
