A 15 year old boy, who told the court that he did not know what transpired on the day he raped their tenant’s toddler, has been sentenced to receive two strokes of the cane.
The teenager from Tafara, who cannot be named for legal reasons, was also ordered by Harare magistrate Noel Mupeiwa to be placed under supervision by a probation officer for the next 18 months.
And the teenager was also slapped with a one year jail term by magistrate Mupeiwa but that jail term was wholly suspended on condition that he does not commit a similar offence in the next five years.
The teenager had pleaded guilty to raping their tenant’s toddler aged 1 year 11 months and in mitigation, he asked for leniency from the court.
The State led by prosecutor Tinashe Makiya proved that on September 28 last year around 1000hrs, the victim’s mother placed the toddler on a baby potty outside the house.
It was proved that the teenager then took advantage of the victim’s vulnerability and took her away from the potty as he took her a few metres away from the house.
And he sat with the victim on a stone where he then raped her once.
Evidence was led in court that the teenager was seen raping the minor by one lady who was doing her chores.
When the teenager was confronted, he then ran away but the lady decided to go and tell the victim’s mother and a report was made at Mabvuku Police station.
And the teenager was arrested for rape, an offence he was subsequently found guilty of. H Metro
